Council approved both consent items unanimously. The 932 Balmoral Road rezoning, development permit with variances, and heritage alteration permit received final Council approval. The towing-regulation bylaws received first, second and third readings; they will return to Council for final consideration.
Move the 932 Balmoral proposal forward with required plan changes and agreements covering rental housing, unit mix, public access, trees, stormwater and transportation measures; consider the heritage and development permits later, after notice and if the zoning amendment is adopted. Also advance the towing-related bylaw changes through three readings and give affected people a way to make written submissions.

Rezoning Application
1. That Council instruct the Director of Planning and Development to prepare the necessary Zoning Regulation Bylaw amendment that would authorize the proposed development outlined in the staff report dated April 24, 2026, for 932 Balmoral Road.
2. That after publication of notification in accordance with section 467 of the Local Government Act, first, second and third reading of the zoning bylaw amendment be considered by Council once the following conditions are met:
a. revisions to the plans to the satisfaction of the Director of Planning and Development to meet minimum drive aisle width in all areas of the underground parkade.
b. revisions to the plans to the satisfaction of the Director of Engineering and Public Work to incorporate stormwater infrastructure per the City of Victoria's Rainwater Management Standards for Green Stormwater Infrastructure.
c. revisions to the plans to the satisfaction of the Director of Parks and Recreation:
i. revise replacement trees on the subject lot and off-site to meet replacement tree requirements per the Tree Protection Bylaw No. 21-035 Schedule “E”
ii. provide documentation from adjacent property owner(s) supporting the removal and replacement of offsite protected trees OS8, OS9 and OS10 in a form satisfactory to the Director of Parks and Recreation.
3. That subject to third reading of the zoning amendment bylaw, the applicant completes the following prior to adoption of the bylaw:
a. prepare and execute legal agreements, with contents satisfactory to the Director of Planning and Development and form satisfactory to the City Solicitor, to secure:
i. a housing agreement securing rental in perpetuity
ii. the proposed unit mix to include no less than 8 three-bedroom and 24 two-bedroom units
iii. a minimum 1.8m wide Statutory Right of Way to secure access through the south and west portion of the site, specifically the north-south and west sections of the mews network and that the SRW agreement include flexibility for the owner to close the SRW from time to time (not permanently) if safety or other conditions at any time reasonably require it.
b. prepare and execute legal agreements, with contents satisfactory to the Director of Engineering and Public Works and form satisfactory to the City Solicitor, to secure:
i. Provision of transportation demand management measures including:
1. provision of 13 on-site long-term oversized cargo bicycle sized stalls 2.4m long x 0.9m wide;
2. contribution to the BC Transit EcoPASS program in the amount of $1,500 per residential unit for use by building residents and employees of commercial uses;
3. provision of 5 long-term bicycle stalls and 3 short-term bicycle stalls in excess of minimum Zoning Regulation Bylaw long-term and short-term bicycle stall requirements;
4. a minimum contribution of $55,000 toward the purchase and operation of a shared electric vehicle;
5. A shared vehicle membership and $100 usage credit for each residential unit; and,
6. the provision of an on-site shared vehicle parking stall and level 2 charger.
4. That adoption of the zoning bylaw amendment will not take place until:
a. all of the required legal agreements that are registrable in the Land Title Office have been so registered to the satisfaction of the City Solicitor.
5. That the above Recommendations be adopted on the condition that they create no legal rights for the applicant or any other person, or obligation on the part of the City or its officials, and any expenditure of funds is at the risk of the person making the expenditure.
Heritage Alteration Permit (Church Site)
That Council, after giving notice, and after adoption of the necessary zoning bylaw, if it is adopted, consider the following motion:
1. “That Council authorize the issuance of the Heritage Alteration Permit No. 00271 for 932 Balmoral Road in accordance with plans submitted to the Planning department subject to:
a. Proposed development meeting all City zoning bylaw requirements except for the following variances to the Zoning Regulation Bylaw:
i. reduce the rear setback from 10.00m to 2.10m;
ii. reduce the institutional vehicle parking stalls located on the church property from 35 stalls to 4 stalls and permit those stalls to be provided on adjacent lands
b. The following variance to the Heritage Designation Bylaw (No. 137) No. 79-28:
i. the approximately 340m2 ground level Sunday School Hall portion of the building is removed from the dark outlined crosshatched section in the sketch in Appendix 2;
c. Final plans to incorporate as much salvageable historic brick as possible into the new development and adaptive reuse of the heritage building, with the final design satisfactory to the Director of Planning and Development
d. Heritage conservation, including preservation, restoration and rehabilitation of the existing First Metropolitan United Church, to be carried out as per the Heritage Conservation Plan by Luxton Heritage Consultants, August 2025.
2. That the Heritage Alteration Permit, if issued, lapses two years from the date of this resolution.”
Development Permit with Variances Application (Mixed Use Residential Site)
That Council, after giving notice, and after adoption of the necessary zoning bylaw amendment, if it is adopted, consider the following motion:
“1. That Council authorize the issuance of Development Permit with Variances No. 00293 for 932 Balmoral Road, in accordance with revised plans submitted to the Planning and Development department subject to:
a. Proposed development meeting all City zoning bylaw requirements, except for the following variances:
Residential property post subdivision
i. reduce the rear lot line setback from 8.0m to 5.16m;
ii. increase rooftop structure projection from 5.00m to 5.10m;
iii. reduce the rooftop structure setback from building edge form 3.00m to 1.65m;
iv. reduce the number of residential long term vehicle parking stalls from 86 stalls to 41 stalls;
v. reduce the number of commercial vehicle parking stalls from 5 stalls to 2 stalls;
vi. reduce the number of visitor parking stalls from 13 stalls to 8 stalls.
2. That:
i. the DPV lapses two years from the date of this resolution if construction is not substantially started within this timeframe; and
ii. the approval of this DPV lapses two years from the date of this resolution if the DP is not issued within this timeframe.”
