I note that only"},{"t":8,"text":"because we do have an evening Councillor meeting this evening,"},{"t":11,"text":"but which I'll speak a little later. Today we have"},{"t":13,"text":"for our consideration two sets of minutes reports from three"},{"t":17,"text":"committees of the whole, two bylaws, one item of new"},{"t":21,"text":"business, and a closed item. But of course, before we"},{"t":25,"text":"begin, we always like to take a moment to ground"},{"t":29,"text":"ourselves and our work and acknowledgement and recognition of the"},{"t":33,"text":"remarkable work undertaken by the two nations on whose territories"},{"t":36,"text":"our city sits in its entirety, the LeQuan good people"},{"t":39,"text":"of the Songhees Nation, and that goes up some nation."},{"t":42,"text":"And to remember and value and treasure and bring homage"},{"t":47,"text":"to the incredible work that the two nations have undertaken"},{"t":51,"text":"over so many generations to ensure that we have the"},{"t":53,"text":"opportunities to make the decisions that we make here in"},{"t":56,"text":"this chamber and to make the decisions that we choose"},{"t":58,"text":"to undertake things to improve the quality of life across"},{"t":64,"text":"our community. The nations themselves have for so many years"},{"t":69,"text":"thought first of how to protect land and the waters"},{"t":72,"text":"that surround this island in a way which allows there"},{"t":75,"text":"to be generations of folk who can live their lives"},{"t":79,"text":"here to the best of their abilities. And we treasure"},{"t":82,"text":"the fact that the generosity of the nation's continues in"},{"t":86,"text":"their stewardship. And in the time that they give to"},{"t":88,"text":"all of us to work with them and to learn"},{"t":90,"text":"from and with them. And to do work together for"},{"t":94,"text":"the better quality of life for all of us who"},{"t":96,"text":"have the privilege of living here in South Vancouver Island."},{"t":100,"text":"With that, we always want to urge one another to"},{"t":102,"text":"take a moment each day to experience and recognise something"},{"t":106,"text":"that brings home that gratitude to each one of us"},{"t":109,"text":"in a way that is very personal. And so that"},{"t":111,"text":"it allows us to actually internalize that thanks and ensure"},{"t":116,"text":"that we understand how valuable it has become. It is"},{"t":120,"text":"to allowing us to live our lives as we choose"},{"t":122,"text":"here in the City of Victoria. ICHM Nicole, I do"},{"t":126,"text":"all of you. We are going to start a regular"},{"t":130,"text":"agenda today, and we'll see how much we can get"},{"t":132,"text":"done before we break for lunch. The first thing that"},{"t":135,"text":"I will do, of course, just in the light of"},{"t":137,"text":"other chairs remarks, it's just remind folks that on Saturday"},{"t":141,"text":"this coming Saturday, June 13th at 10 a. m. at"},{"t":143,"text":"railroads, celebration of life honouring the work and life of"},{"t":149,"text":"our dear late Councillor colleague, Langford Councillor Lillian Spock. It"},{"t":155,"text":"is open to the public. I suspect it will be"},{"t":157,"text":"well attended in respect and honour for Lillian, and I"},{"t":161,"text":"know that, as I mentioned earlier today, Lillian was a"},{"t":165,"text":"great proponent of everything environmental. And so for those of"},{"t":168,"text":"folks who are able to go on Saturday, one might"},{"t":170,"text":"want to think a little bit about going there in"},{"t":173,"text":"a way different than in a single occupancy vehicle, unless"},{"t":175,"text":"you're carpooling with many folks in your own vehicle. With"},{"t":180,"text":"that said, that will be a somber morning, but an"},{"t":182,"text":"important one to honour Lillian's lifetime of work to Langford"},{"t":186,"text":"and to Vancouver Island in general. I am not aware"},{"t":191,"text":"of any late items that need to be added to"},{"t":193,"text":"our agenda today, and so that when we was on"},{"t":195,"text":"to look for a motion to approve the agenda as"},{"t":198,"text":"published. Thank you, Councillor Coleman, secreted by Councillor Gardner. In"},{"t":202,"text":"a discussion on the published agenda, not seeing any, all"},{"t":206,"text":"those in favor of the published agenda. Anyone opposed. That"},{"t":210,"text":"is unanimous. Now there are in fact 10 items proposed"},{"t":214,"text":"for the consent agenda, so I'm going to walk through"},{"t":216,"text":"these carefully for the information of the public. And then"},{"t":219,"text":"I will ask if anyone wishes to remove any of"},{"t":222,"text":"them for further discussion. Trist isn't a reminder items are"},{"t":227,"text":"placed on the consent agenda at Council. If they receive"},{"t":230,"text":"unanimous support at committee or they are preliminary readings of"},{"t":233,"text":"bylaws, as we will have a chance to consider those"},{"t":236,"text":"bylaws for final adoption at another time. So proposed today,"},{"t":242,"text":"item F1, the minutes from the Council to Fallow, meeting"},{"t":246,"text":"held on March 12th. That would be the daytime council"},{"t":248,"text":"meeting. Item F2, the daytime council meeting minutes for the"},{"t":252,"text":"meeting held on April the 2nd. Item G1AB, the development"},{"t":258,"text":"variants permit for 749 Douglas Street downtown. Item G1AC, the"},{"t":265,"text":"general local election report for 2026. Item G1AD, the technical"},{"t":271,"text":"high angle rope rescue program tower crane rescue services agreement."},{"t":277,"text":"Item G1AE, the Council Member Motion with regard to the"},{"t":281,"text":"Cumberland BC Minors Memorial Graveside Vigil for 2026. Item G1BA."},{"t":289,"text":"The rezoning application and development permit with variances application for"},{"t":292,"text":"the properties at 517 and 533 Chatham Street and 530532"},{"t":299,"text":"and 536 Herald Street. G1BC, the Council Member Motion with"},{"t":304,"text":"regard to advocacy to extend local government climate action program"},{"t":309,"text":"funding. Item G1BD, the Council Member Motion, looking to increase"},{"t":315,"text":"protections for Victoria renters. And finally, item H1, the Bylaws"},{"t":320,"text":"for Street Entertainment, and again those are preliminary readings. So"},{"t":324,"text":"noting all 10 of those proposals, would anyone like to"},{"t":327,"text":"remove any one of them for further discussion? Councillor Gardner?"},{"t":333,"text":"That would be item G1BD and item H1. Yep. So"},{"t":339,"text":"that is just for the information of the public. Actually,"},{"t":342,"text":"I'll ask the question again before I say that. Anything"},{"t":344,"text":"else anyone would like to get? Councillor Kim? Actually, is"},{"t":346,"text":"it possible to add? You can. What would you like"},{"t":350,"text":"to add? The two from Community of the Whole this"},{"t":353,"text":"morning. Well, generally our convention has been to allow those"},{"t":357,"text":"to go forward through today. Sure. Anyway. Okay. They're fairly"},{"t":360,"text":"brief and they were, I believe, uh, carried not unanimously,"},{"t":364,"text":"but almost. In which case could I also see about"},{"t":366,"text":"adding H2. Is H2 in adoption? Yes it is. So"},{"t":370,"text":"generally speaking, we don't put adoptions on because it is"},{"t":373,"text":"the last chance that Council has to comment. And so"},{"t":376,"text":"we'd like to make sure that that occurs. So I'll"},{"t":380,"text":"ask again, anything else anyone would like to remove. Not"},{"t":386,"text":"seeing anything else. So just as a reminder, um, the"},{"t":388,"text":"request has been to remove item G1BD, the Council Member"},{"t":392,"text":"Motion, uh, increasing protection for Victoria rentals. A renters rather."},{"t":397,"text":"And item H1, the Bylaws for street entertainment. That leaves"},{"t":400,"text":"eight items for the consent agenda consideration. I won't read"},{"t":404,"text":"them all out again. I will just read the actual"},{"t":406,"text":"numbers and that would be item F1, item F2, item"},{"t":411,"text":"G1ab G1AC. One thing. Uh, up next is item F."},{"t":448,"text":"These would be the consideration of the minutes. These would"},{"t":450,"text":"be the minutes from the Council to follow Committee with"},{"t":452,"text":"the whole meetings on March the 12th and April the"},{"t":455,"text":"2nd. Both of those were in fact adopted with the"},{"t":459,"text":"consent agenda and just as a reminder to everyone who's"},{"t":462,"text":"watching. When something is adopted at the daytime council, it"},{"t":466,"text":"is the final consideration. And so those things are now"},{"t":469,"text":"considered to be approved. Finally and will not return again"},{"t":471,"text":"to this table. That takes us on to then the"},{"t":476,"text":"Committee of the Whole report from May 21st. The first"},{"t":480,"text":"item up, which was not on me the consent agenda"},{"t":483,"text":"is what we colloquially have called them cathedral application. This"},{"t":487,"text":"is the Rezoning application and the development permit with variances"},{"t":490,"text":"application with regard to 829 and 2899 4th Street. And"},{"t":497,"text":"oh no, I'm sorry. This is not the cathedral application."},{"t":498,"text":"Oh yes it is. No it's not. That's sorry. That's"},{"t":501,"text":"later. Gotcha. 829 to 899 4th Street and 846 to"},{"t":504,"text":"856 Broton. This is the rezoning application 00901. And the"},{"t":509,"text":"development permit with variance is application 00297. Uh, this was"},{"t":514,"text":"moved and carried and adopted 72, but there were notes"},{"t":518,"text":"of opposition. So we'll have that tap on again. That"},{"t":521,"text":"was something to move this please. Councillor Dell is moving"},{"t":524,"text":"this. Anyone like to second this please. This was the Council Member"},{"t":610,"text":"Motion with regard to graffiti prevention. Options for age restrictions,"},{"t":614,"text":"retail access and storage controls with spray paint. There were"},{"t":618,"text":"a number of folks in opposition to this. I believe"},{"t":620,"text":"Councillor Hamlin, you moved this originally. Would you like to"},{"t":622,"text":"move it again? Thank you. And would someone like this"},{"t":625,"text":"second is Councillor Gardner. Council Hemd, anything you'd like to"},{"t":629,"text":"add at this time? Nope. Councillor Gardner or anything you'd"},{"t":631,"text":"like to add? Nope. Anyone else like to add anything"},{"t":634,"text":"to this discussion. Not seeing any particular comments further. All right."},{"t":665,"text":"That does take us through the items that were part"},{"t":668,"text":"of the May 21st committee of the whole. I'm going"},{"t":670,"text":"to suggest that we actually pause there. We before we"},{"t":673,"text":"go on to the May 28th report because it is"},{"t":676,"text":"complete and also has a number of fairly lengthy pieces"},{"t":680,"text":"on it. So it is now by my calculation just"},{"t":683,"text":"12 noon. So let us return at one o'clock. And"},{"t":686,"text":"we will resume our daytime council meeting with considerations of"},{"t":689,"text":"the report from the May 28th Committee of the whole"},{"t":691,"text":"meeting."},{"t":705,"text":"The report from the 28th Committee of the Whole Meeting."},{"t":709,"text":"The first item up, G1BA, that is the rezoning application"},{"t":714,"text":"and development permit with variances application. For 517 and 533"},{"t":719,"text":"Chetum Street and 530532 and 536 Herald Street. That was"},{"t":724,"text":"placed on the consent agenda and adopted as part of"},{"t":728,"text":"that consent agenda. And so that item has been resolved."},{"t":733,"text":"So that takes us on to item G1BB. This was"},{"t":737,"text":"not unanimous committee. And so this is the rezoning application"},{"t":743,"text":"for 90912 Vancouver Street, 911 Quadrantra Street and 930 and"},{"t":750,"text":"990 Birdette Avenue. And that is known as the Cathedral"},{"t":755,"text":"item. And before we proceed with that, I'm going to"},{"t":757,"text":"turn to Councillor Coleman, who is going to recuse himself."},{"t":760,"text":"Thank you, your worship. Yes, I'm going to recuse myself"},{"t":762,"text":"as I did in past iterations for both a perception"},{"t":767,"text":"of bias, because I'm a 40 - year parishioner and"},{"t":771,"text":"a member of having previously been a member of Paris"},{"t":775,"text":"Council and a potential pecuniary interest because my wife used"},{"t":778,"text":"to work on the precinct and now gets a pension"},{"t":780,"text":"from the Anglican diocese. Thank you very much. And I"},{"t":784,"text":"will note that Councillor Coleman has asked us to take"},{"t":786,"text":"as much time as we need to discuss this. So"},{"t":789,"text":"he may deal with other matters. There you go. That"},{"t":792,"text":"being said, as I mentioned, this is the rezoning application"},{"t":795,"text":"for what we commonly known as the Cathedral application. We"},{"t":800,"text":"put the very long proposal up there on the screen."},{"t":803,"text":"Thank you very much. I'm happy to move that because"},{"t":805,"text":"I'm going to propose an amendment. Someone like, thanks very"},{"t":808,"text":"much Councillor Thompson. So before I speak to the entire"},{"t":813,"text":"motion, I'm going to suggest an amendment that would be"},{"t":816,"text":"placed at the end of the sentence at 3A. So"},{"t":824,"text":"if you take your cursor down to 3A, when it"},{"t":827,"text":"says site plan is currently proposed. Comma, after the word"},{"t":830,"text":"proposed. Very end there. And I did send a few"},{"t":836,"text":"words to staff. Do you add in there? If you"},{"t":840,"text":"could add that in there, that would be super helpful."},{"t":847,"text":"I can also read it out if it's not very"},{"t":849,"text":"long, but there you go. Thank you. So just briefly, on the only of the amendment,"},{"t":866,"text":"and I'll reserve comments on the main motion for a"},{"t":868,"text":"little bit later. Just on the amendment, I think we"},{"t":870,"text":"had a very extensive conversation when this first came to"},{"t":873,"text":"committee dealing with the amount of public engagement that had"},{"t":876,"text":"been undertaken by the applicant and the different opportunities there"},{"t":881,"text":"had been for commentary over the last few years, as"},{"t":883,"text":"this has been for a few years. And so it"},{"t":885,"text":"is my opinion that the alternate motion, which we, it's"},{"t":890,"text":"the one on the screen, which is the one that"},{"t":890,"text":"we sent here for final consideration today did include sufficient"},{"t":896,"text":"information to not necessarily require an additional COLUC meeting. And"},{"t":900,"text":"if I recall correctly, there were multiple comments on wanting"},{"t":902,"text":"to ensure that, uh, the changes that we had proposed"},{"t":905,"text":"would not necessarily slow down the process of the rest"},{"t":908,"text":"of the undertaking of this particular application. Despite the fact"},{"t":913,"text":"that we did add some additional things around it returning"},{"t":915,"text":"to the advisory design panel and some other things as"},{"t":917,"text":"well. So I believe that the additional calic media is"},{"t":921,"text":"unnecessary. And that's why I'm proposing this amendment. Councillor Loitville."},{"t":924,"text":"Thanks. It's through you, Mayor. I don't have anything to"},{"t":927,"text":"add to that just that I want to reiterate that"},{"t":929,"text":"we don't want to slow things down. And my understanding"},{"t":933,"text":"is correct. The last CALU meeting was waived by the"},{"t":937,"text":"CALC and it was approved with a more height at"},{"t":943,"text":"the CALIC meeting previous to that. So it doesn't seem"},{"t":946,"text":"like it makes much sense for it to go back"},{"t":948,"text":"to CALIC. I think we just need to move forward"},{"t":951,"text":"and get this project going. I"},{"t":960,"text":"actually found it very problematic that the CALUC meeting was"},{"t":964,"text":"waived given that the, um, uh, proposal, which we considered"},{"t":969,"text":"was very, very different from the one from the Calicov,"},{"t":973,"text":"when was it. 2024. Is that correct? I think so."},{"t":977,"text":"And so it was significant during day waved it. And"},{"t":980,"text":"this would have been their chance maybe to have one"},{"t":983,"text":"so that the residents can speak. So I can't support"},{"t":986,"text":"this amendment. Thank you. I mean, if I"},{"t":994,"text":"recall that there was one proposal that went to ADP"},{"t":998,"text":"and then it got and then the one that went"},{"t":999,"text":"to us was a little bit different than the one"},{"t":1000,"text":"that went to ADP. And then what, what actually went"},{"t":1004,"text":"to the CALIC? What is it the one that ADP"},{"t":1007,"text":"had commented on or was it a different version. Mr."},{"t":1009,"text":"Johnston, do you know that? Thank you through you mayor."},{"t":1015,"text":"Um, I believe the version of the proposal that, uh,"},{"t":1021,"text":"ADP reviewed was the same version that Council saw, but,"},{"t":1025,"text":"uh, the, uh, version that went to the Calluk was"},{"t":1029,"text":"the original proposal, which had a taller building behind directly"},{"t":1033,"text":"behind the cathedral and a taller building at the corner"},{"t":1035,"text":"of Vancouver and Burdette and then lower scale buildings across"},{"t":1038,"text":"the rest of the site. And it's slightly different density"},{"t":1041,"text":"than, than what was proposed. Okay. Um, one of the"},{"t":1046,"text":"questions that was asked at the previous meeting was what"},{"t":1050,"text":"ADP had advised for advice and the fact that they"},{"t":1054,"text":"had not necessarily taken that advice in the most recent"},{"t":1058,"text":"version, which is one of the reasons we set it"},{"t":1060,"text":"back to ADP. Yes. So, okay, if I've understood correctly"},{"t":1065,"text":"then that, um, there was one proposal made that had"},{"t":1068,"text":"some taller buildings. And that's what ADP commented on. No,"},{"t":1073,"text":"I'm sorry. I'm, I'm getting lost then. I'm sorry. Mr."},{"t":1077,"text":"Johnson, can you just walk us through the order? It"},{"t":1079,"text":"might be helpful. Uh, through the mayor, I'll start and"},{"t":1081,"text":"then, uh, or maybe it's better if I just hand"},{"t":1085,"text":"it over to, uh, senior planner Bitanza's online. And he"},{"t":1089,"text":"can walk us through it. And there he is. Hello,"},{"t":1091,"text":"Mr. Cotanzo. Can you, I don't know if you've heard"},{"t":1093,"text":"this conversation, but could you sort of walk us through"},{"t":1095,"text":"the steps that, uh, took us to the most recent"},{"t":1098,"text":"application version. Sure. So, uh, through yourself, the, the initial"},{"t":1103,"text":"version that went to Kalek, um, that calic has reviewed"},{"t":1107,"text":"had the 25 story, uh, building directly behind the cathedral."},{"t":1112,"text":"And then at the corner of Burdet and Vancouver and"},{"t":1115,"text":"18 story building. And then, um, the remainder of the"},{"t":1118,"text":"site was four and six story buildings. So that's the"},{"t":1121,"text":"version that went to Kallek. That version was, uh, following"},{"t":1124,"text":"that, uh, revised, um, to have the 18 story building"},{"t":1130,"text":"mid block on Burdette and a 12 story building in"},{"t":1133,"text":"behind the cathedral. And that's the version that went to"},{"t":1136,"text":"both the Heritage Advisory panel and the advisory design panel"},{"t":1140,"text":"and Council at Committee of the Whole. Great. Thank you."},{"t":1143,"text":"Okay. So then in a sense, I was correct in"},{"t":1145,"text":"that there was, there was a calic version had some"},{"t":1148,"text":"taller buildings. That version changed. But then Council amended the"},{"t":1155,"text":"direction to allow, I voted against it personally as amendment,"},{"t":1159,"text":"but it carried to allow the proponents to work with"},{"t":1161,"text":"staff to consider in a sense going back to or"},{"t":1164,"text":"splitting the difference or having some options about realigning with"},{"t":1168,"text":"the previous version that had gone to EDP. Yes, I"},{"t":1171,"text":"believe that's right, Mr. Johnson. Right. Uh, through the mayor,"},{"t":1176,"text":"um, the direction that Council provided at Committee of the"},{"t":1180,"text":"Whole was to, um, revised the proposal to align with"},{"t":1185,"text":"the direction or the recommendation that came from ADP. So"},{"t":1189,"text":"ADP had reviewed the same version that was presented to"},{"t":1192,"text":"Council. So the 18 story building kind of mid block"},{"t":1195,"text":"on Burdett. And their recommendation, part of their recommendation was"},{"t":1200,"text":"to consider increasing the height of that 18 story building"},{"t":1205,"text":"slightly. Uh, and reducing the height of the adjacent eight"},{"t":1208,"text":"story buildings. Um, so it wasn't necessarily returning to, uh,"},{"t":1214,"text":"align with the original proposal, but sort of some shifting"},{"t":1218,"text":"of building height along the burdet street. Okay. If you"},{"t":1221,"text":"could just read actually the number two, but we ended"},{"t":1224,"text":"up approving was that adjust the application to better align"},{"t":1227,"text":"with the recommendations of. So as Mr. Johnson said, it"},{"t":1230,"text":"isn't necessarily a return to the original. So I, okay."},{"t":1233,"text":"And the reason I'm asking these questions is I'm trying"},{"t":1235,"text":"to figure out if there's any value in sending it"},{"t":1237,"text":"back to CALIC. And I guess there's, there's some haggling"},{"t":1241,"text":"going on between 18 and 25 stories, but I think"},{"t":1244,"text":"to my mind, CALAC has already had the opportunity to"},{"t":1246,"text":"look at the higher density one. If anything, there's going"},{"t":1248,"text":"to be less density on what was originally proposed here."},{"t":1251,"text":"So, uh, I, it hasn't come up for me.
