Today we have for our consideration one report"},{"t":44,"text":"from a Committee of the Whole meeting, two bylaws for"},{"t":47,"text":"preliminary reading and adoption and a few closed matters. But"},{"t":52,"text":"of course, before we begin, we'd like to take a"},{"t":55,"text":"moment to ground ourselves and reflect briefly on the remarkable"},{"t":60,"text":"opportunities that we have in enjoying a very rich relationship"},{"t":63,"text":"with the two nations on whose territories our city sits"},{"t":66,"text":"in its entirety. The song he's nation and the co"},{"t":69,"text":"- subsumnation of the Lekmungan people. When we have a"},{"t":72,"text":"day like this, and we look around outside, and we"},{"t":75,"text":"have the ability to see what extraordinary results have accrued"},{"t":79,"text":"from the generations of dedication, that the two nations and"},{"t":83,"text":"their members have dedicated to preserving protecting and nurturing the"},{"t":88,"text":"land and waters that surround these lands. And so sometimes"},{"t":92,"text":"I think it's important for us to, and I urge"},{"t":95,"text":"us all individually to take a few minutes in each"},{"t":97,"text":"day to find some experience, whether it's a sound or"},{"t":101,"text":"a taste or an observation that brings home to you,"},{"t":105,"text":"I hope, something personal that allows you to be generous"},{"t":110,"text":"in your reflection and celebratory and your understanding of how"},{"t":115,"text":"lucky we all are to be here. And to be"},{"t":118,"text":"placed in these positions by the will of the people"},{"t":120,"text":"to make difficult decisions, hopefully, with an eye to what's"},{"t":124,"text":"gone before, the challenge of those issues that face us"},{"t":128,"text":"today with also the hope that we are doing things"},{"t":131,"text":"for people who are coming after us. And when we"},{"t":133,"text":"work together with the nations, we have an opportunity to"},{"t":136,"text":"have diverse and really challenging perspectives and work with each"},{"t":140,"text":"other to find the common solutions. And the pragmatic way"},{"t":144,"text":"future forward rather that will hopefully create the best decisions"},{"t":149,"text":"for all of our residents. Past, present, and future. And"},{"t":153,"text":"so with that, we'd like to always so say a"},{"t":155,"text":"very simple thing, and that is to say hi to"},{"t":158,"text":"Cassiumniquilia, which is to say thank you, but also to"},{"t":161,"text":"offer our respect to those who are here today with"},{"t":163,"text":"us, either in these chambers, in these buildings, in the"},{"t":168,"text":"community, in the families that surround us. And thank each"},{"t":171,"text":"one of us for the leadership that we choose to"},{"t":173,"text":"make moment by moment throughout our lives. Hychkasian Nikolia. There are three items"},{"t":204,"text":"proposed for the consent agenda, and as I often do,"},{"t":207,"text":"I will remind the public that they are proposed here"},{"t":209,"text":"because they were adopted or considered rather. Unanimously at an"},{"t":213,"text":"earlier committee of the whole meeting. And so these are"},{"t":216,"text":"three proposals for the consent agenda item F1AA, the Heritage"},{"t":220,"text":"Designation Application for 1784 Denmin Street. Item F1AB, the endorsement"},{"t":227,"text":"of funding and award applications on behalf of the City."},{"t":231,"text":"Item F1AC, a Council member motion with regard to strategies"},{"t":234,"text":"and resources to require cooling in Victoria's rental buildings. Does"},{"t":239,"text":"anyone wish to remove any of those. Oh, okay. No"},{"t":244,"text":"one will rule. I'm here at Councillor Coleman is moving"},{"t":246,"text":"the consent agenda. Is your secondary Councillor Kim, all those"},{"t":248,"text":"in favor, and you want to posed. That is unanimous."},{"t":253,"text":"Thank you. That would usually take us on to reports"},{"t":256,"text":"from committees. And as I mentioned, there is one report"},{"t":258,"text":"from one committee. That would be the report from the"},{"t":261,"text":"May 14th Committee of the whole meeting, and those would"},{"t":263,"text":"be three items that we just placed on the consent"},{"t":265,"text":"agenda items F1AA, F1AB, and F1AC. All three of those"},{"t":270,"text":"replaced on consent and adopted a moment ago. And as"},{"t":274,"text":"a reminder, since we are sitting at Council, those decisions"},{"t":277,"text":"are final, and so we will not see those items"},{"t":279,"text":"again. That would take us on usually to item F1B,"},{"t":284,"text":"a report from this morning's or this afternoon's or today's"},{"t":287,"text":"Committee of the Whole Meeting. There were no matters that"},{"t":290,"text":"we needed to consider same day consideration or give same"},{"t":294,"text":"day consideration today. And so we do not need to"},{"t":297,"text":"have any consideration of today's report. That takes us on"},{"t":300,"text":"to bylaws. Our first Bylaw is Bylaw G1. This is"},{"t":304,"text":"the Bylaw Amendments pursuant to build 25. There are two"},{"t":308,"text":"recommendations. First are the first, second, and third readings, the"},{"t":312,"text":"preliminary readings of the Bylaw. And second is the adoption"},{"t":314,"text":"of the same. We'll do those individually because they are"},{"t":317,"text":"separate, and so I would look for someone to move"},{"t":319,"text":"first, second, and third reading of the Zoning Regulation Amendment"},{"t":322,"text":"bylaw and the Zoning Regulation Amendment Bylaw No. 1368 and"},{"t":326,"text":"number 22. Al - Sir Kim is moving, Councillor Gardner,"},{"t":330,"text":"seconding Councillor Kim or Gardner, any discussion. Yes, go ahead"},{"t":334,"text":"Council Predictor. Thank you. First probe, excuse me, a bit"},{"t":338,"text":"of clarification. What notice is went out, all of a"},{"t":341,"text":"sudden I got many phone calls, and several emails. And"},{"t":345,"text":"then since then, a couple days later, we got others."},{"t":348,"text":"And so I immediately wrote to staff, because I wanted"},{"t":351,"text":"to ensure that this was indeed, not a staff, a"},{"t":356,"text":"city, rezoning. This is not a rezoning by any of"},{"t":359,"text":"the landowners. Cause that is very important, and because the"},{"t":363,"text":"answer was that it is a city one. I did"},{"t":365,"text":"not have to recuse myself in any way, even though"},{"t":368,"text":"I am a few feet from one of the properties."},{"t":370,"text":"So I wanted to make sure that that was very"},{"t":372,"text":"clear. And I want to, and because of all the"},{"t":376,"text":"information that came out, from residents, uh, speaking to me,"},{"t":382,"text":"phoning and emails, et cetera, I want to discuss a"},{"t":385,"text":"couple of them, and I have a few questions. So,"},{"t":388,"text":"um, as notices, this is mostly for staff. As notices"},{"t":391,"text":"were posted in the community notified of this bylaw to"},{"t":394,"text":"amend the zoning bylaw, we received the emails, as I"},{"t":397,"text":"said. Now the wording on a community notice raised red"},{"t":400,"text":"flags and created angst. Specific concerns were raised on two"},{"t":405,"text":"of the three properties, namely 934th Street and Fishman's Wharf."},{"t":411,"text":"So I wish to confirm the intent of this bylaw"},{"t":415,"text":"change, and I have questions, and I want just to"},{"t":417,"text":"read one of the sentences that is in this document"},{"t":421,"text":"force. Section 3D states. The Zoning Math is amended to"},{"t":426,"text":"indicate that 13, 14 - 13 - 18 Wharf Street,"},{"t":432,"text":"9. 30 4th Street, and Fishermans Wharf are subject to"},{"t":435,"text":"the subject to cite - specific regulations. So my question"},{"t":441,"text":"is, Jeff, regarding 9. 30 4th Street, we have received"},{"t":445,"text":"correspondence from the owner of 926 4th Street, Lun's Auctioneers."},{"t":450,"text":"My question to staff is, the Section D that I"},{"t":454,"text":"read of the bylaw before us recognise the easement as"},{"t":459,"text":"established in January of 1981 for the owner of 926"},{"t":463,"text":"4th Street over part of the 930 4r Street property."},{"t":467,"text":"Very good, and I believe we have planning staff here"},{"t":469,"text":"who can answer that question. My name is Mike Angroov,"},{"t":478,"text":"Acting Manager of Planning and Regulatory Services. Uh, so forward"},{"t":482,"text":"9. 30 Fort Street that Eastmint has come up in"},{"t":484,"text":"the past during the original rezoning for this property, uh,"},{"t":487,"text":"at the time it was determined to be a private"},{"t":489,"text":"matter between the two landowners that did not involve the"},{"t":492,"text":"city. So that would not be included in the Zeit"},{"t":494,"text":"- specific region. So it's not included, thank you. Okay,"},{"t":497,"text":"regarding Fisherman's Wharf, there is concern that the bylaw change"},{"t":501,"text":"may alter the character and activity at Fisherman's Wharf. A"},{"t":505,"text":"resident has compared the terms of fishing morph plan to"},{"t":508,"text":"the proposed M1 zone. Staff, could you please load up"},{"t":512,"text":"his comparison."},{"t":530,"text":"Thank you. Alright, so, uh, resident sent this to all"},{"t":535,"text":"of us, I think yesterday the day before, I can't"},{"t":537,"text":"remember, which we all receive. So, my question to staff"},{"t":541,"text":"is, does Section D of the bylaw before us recognise"},{"t":545,"text":"the provisions as identified within the Fishman's Worth plan on"},{"t":548,"text":"the right side of the screen as being specific regulations"},{"t":552,"text":"that modify the M1 Zone and shown on the left"},{"t":554,"text":"side of the screen. Mr. Angrove? Uh, through the mayor,"},{"t":559,"text":"thank you for the opportunity to address this correspondence. Yes,"},{"t":562,"text":"it does. It does. Okay, to clarify, the M1 conditions"},{"t":566,"text":"on the left will not apply to fishermen's Wharf, correct?"},{"t":570,"text":"Through the Mayor, correct. So for instance, on this table"},{"t":574,"text":"here, uh, couple of them that I not are, the"},{"t":577,"text":"residential noting the prohibition, uh, the site - specific regulations"},{"t":581,"text":"that we have drafted create new uses that match that"},{"t":584,"text":"of the existing zone. So for live aboards, floating units,"},{"t":588,"text":"uh, and allow for those types of units. Similarly for"},{"t":591,"text":"the commercial, uh, we have created a new use for"},{"t":594,"text":"floating commercial units that will be permitted in this zone."},{"t":598,"text":"We have limited the height to the existing zone, et"},{"t":602,"text":"cetera. Thank you. So the other words, the fishermen's work"},{"t":605,"text":"plan is still in effect. If this proves, correct? Uh,"},{"t":610,"text":"through the mayor, yes, we have noticed. That takes us to a couple of items"},{"t":665,"text":"of closed materials. And so Mr. Kingsley, I'm going to"},{"t":669,"text":"ask you to remind the public and council of the"},{"t":671,"text":"Sections of the Community Charter that either require or enable"},{"t":675,"text":"counsel to consider matters and close. Certainly, Mayor, the reasons"},{"t":679,"text":"proposed the closed meeting today are under Section 91A of"},{"t":681,"text":"the Community Charter regarding personal information about an identifiable individual"},{"t":685,"text":"who holds her as being considered for a position appointed"},{"t":687,"text":"by the municipality. Section 91F regarding a law enforcement matter."},{"t":692,"text":"Section 91i regarding the receive advice that is subject to"},{"t":695,"text":"solicitor client privilege. And Section 92b regarding the consideration of"},{"t":699,"text":"information received and held in confidence related to negotiations between"},{"t":703,"text":"the municipality and another level of government.
