Today we have for our"},{"t":7,"text":"consideration reports from three committees of the whole, five bylaws"},{"t":12,"text":"for preliminary readings or final adoption, and one short -"},{"t":15,"text":"term business license appeal. But before we begin, we always"},{"t":19,"text":"like to take a moment to ground ourselves and our"},{"t":22,"text":"work and our decision - making and acknowledgement and expression"},{"t":25,"text":"of gratitude to the two nations on whose territories our"},{"t":29,"text":"city sits in its entirety, the cosopsum nation, and the"},{"t":32,"text":"Songhees Nation of the La Quangan people. We enjoy and"},{"t":37,"text":"have nurtured a very rich relationship with the two nations,"},{"t":40,"text":"their leadership, and their members. And we appreciate their continuing"},{"t":43,"text":"generosity and willingness to work with us and to continue"},{"t":47,"text":"to nurture that relationship. It is a remarkable opportunity that"},{"t":50,"text":"we have explored over the last dozen or so years"},{"t":53,"text":"to encounter different moments of learning and different opportunities to"},{"t":58,"text":"work together, and hopefully to make decisions that encourage and"},{"t":62,"text":"improve the lives of all of the people who live"},{"t":64,"text":"in this territory. Both nations have taken the time over"},{"t":69,"text":"these years to ensure that we have, as a city,"},{"t":73,"text":"and as many individuals within the city opportunities to work"},{"t":76,"text":"with and counter, learn, and simply be immersed in the"},{"t":81,"text":"decades and generations of learning that the nations have been"},{"t":85,"text":"so generous in offering and sharing. And so it is"},{"t":88,"text":"appropriate as become nearer to the end of our term"},{"t":91,"text":"to continue to express our gratitude and our acknowledgement of"},{"t":95,"text":"how much time, effort, generosity, and individual and collective offerings"},{"t":102,"text":"that the two nations continue to give to work with"},{"t":105,"text":"us and to help us work together. We'd like to"},{"t":107,"text":"say thank you in the language of the people, and"},{"t":110,"text":"that is, of course, the La Quongan language and the"},{"t":112,"text":"simplest term, which most people now know is simply to"},{"t":115,"text":"say hi to go or highchm or hydricyumniaquilia, all three"},{"t":118,"text":"of which are versions of, thank you in expressing gratitude"},{"t":121,"text":"and respect. And so I would offer to whoever is"},{"t":125,"text":"listening or whoever's here, whichever of those makes sense to"},{"t":127,"text":"you, and that is to say hi, because the Mcwilia."},{"t":133,"text":"I do not have any remarks to share today, nor"},{"t":135,"text":"am I aware of any late items that need to"},{"t":137,"text":"be added to the agenda. And so that takes us"},{"t":140,"text":"on to item D. This is the published agenda. Someone"},{"t":142,"text":"like to move the published agenda. And so today"},{"t":168,"text":"for our consideration, our four items, as I mentioned, item"},{"t":172,"text":"F1AB, the noise bylaw review, item F1BC, a council member"},{"t":177,"text":"motion, finding approaches for the City of Victoria to further"},{"t":180,"text":"respond to America's tradeware with Canada. Item G1, the Amendment"},{"t":185,"text":"Bylaw for Amedited Cost charges, and item G2, the Amendment"},{"t":188,"text":"Bylawlaw for Market Rental Building Revitalization Tax Exemption. Would anyone"},{"t":194,"text":"like to remove any of those Councillor Gardner? No, nothing"},{"t":196,"text":"else. You're all good. All right, so I'm like, move"},{"t":198,"text":"the consent agenda. Councillor Gardner is moving, Councillor Kim is"},{"t":201,"text":"seconding. All those in favor. And I want to pose,"},{"t":205,"text":"is unanimous. That takes us on, excuse me, two reports"},{"t":210,"text":"for the committees. The first one is from September the"},{"t":212,"text":"3rd. Seems like a bit a ways to go. This"},{"t":216,"text":"is one item which was not unanimous, and that is"},{"t":219,"text":"item F1AA. This is the rezoning application and development variance"},{"t":223,"text":"permit application for 770 Pemberton Road. There were a number"},{"t":228,"text":"of councillors opposed to this at committee, and so that's"},{"t":230,"text":"why it's here for final consideration. We'd summon like to"},{"t":232,"text":"move that, please. Councillor Kim is moving. There is no"},{"t":238,"text":"seconder. Well, then I'll second, just for discussion. Sure. Since we consider this proposal,"},{"t":259,"text":"we've received more correspondence, including from residents who live right"},{"t":261,"text":"on the complex. And I think the original owner who"},{"t":265,"text":"supported the Covenant and helped create it. And while council"},{"t":269,"text":"cannot bind future councils, we must respect commitments with the"},{"t":273,"text":"public through Covenants. The act of altering this covenant would"},{"t":276,"text":"be akin to Council approvals being written in pencil. Beyond"},{"t":282,"text":"legal considerations, this is a matter of trust. Of city"},{"t":285,"text":"and of council and the city. I cannot support this"},{"t":290,"text":"proposal. This Bible. Thank you very much, Councillor Loughton. Mr."},{"t":298,"text":"U, Mayor, I have also had conversations between committee in"},{"t":302,"text":"here, and particularly with the Victoria Heritage Foundation and the"},{"t":309,"text":"concerns about the covenant. And I believe I originally voted"},{"t":312,"text":"in favor of this, but today I will be opposing."},{"t":317,"text":"Very good. Thank you very much. Anybody else? So that is adopted, not"},{"t":344,"text":"report from the Committee with the Hole. The next item"},{"t":347,"text":"from the September 3rd Committee of the Whole was on"},{"t":349,"text":"the consent agenda because it was previously carried unanimously. So"},{"t":352,"text":"that moves us on to item F1B. This is the"},{"t":356,"text":"Committee of the Whole report from September the 10th. Again,"},{"t":359,"text":"there are three items here, two of which were not"},{"t":361,"text":"unanimous, so we'll deal with those individually. The first one"},{"t":364,"text":"is item F, 1BA. This is the rezoning application and"},{"t":369,"text":"development permit with variances application for the property at 617"},{"t":373,"text":"- 635 Roten Street 620 - 3630 Courtney Street and"},{"t":378,"text":"901 through 919 Gordon Street. Someone like to move that,"},{"t":382,"text":"please? Thanks, Councillor Caradona. It's for a seconder, Councillor Kim."},{"t":386,"text":"Council Cardona, any comments? Councillor Kim, many comments. Any other"},{"t":390,"text":"comments. Councillor Gardner. No, you were first. Thank you. Thank"},{"t":398,"text":"you. We have since this was considered, we've also received"},{"t":403,"text":"a lot of correspondence from businesses downtown and nearby. And"},{"t":408,"text":"such as Magnolia and Franky's, et cetera. And I'm just"},{"t":413,"text":"going to put some headlines in that was given from"},{"t":417,"text":"one of these letters that we got. And the objections"},{"t":420,"text":"were, of course, building height and heritage character. They're very"},{"t":423,"text":"concerned about Old Town, a lot of businesses use Old"},{"t":427,"text":"Town. They went to Old Town for a reason, and"},{"t":429,"text":"they respect Old Town, and they think that this one,"},{"t":433,"text":"they believe that this one exceeds the limits of respect"},{"t":436,"text":"to Old Town. They're very concerned about loss of public"},{"t":439,"text":"property parking capacity. And I think that has been said"},{"t":447,"text":"by many, many people. And they're also concerned with the"},{"t":452,"text":"developer engagement practices. And. So I don't want to read"},{"t":459,"text":"this whole paragraph because I wasn't involved in the conversation,"},{"t":462,"text":"but the conversation of consultation over the last few years"},{"t":466,"text":"was the developer was not appreciated by the nearby businesses."},{"t":472,"text":"And. So the proposal, its height, and the degree to"},{"t":476,"text":"which it departs from the established planning framework intended to"},{"t":479,"text":"protect Old Town's character. For me, it's not supportable. Thank"},{"t":483,"text":"you. Thank you very much. Councillor Hammond. Nope, not word."},{"t":487,"text":"No, I'm sorry. I thought I saw your hand go"},{"t":489,"text":"up. My apologies. Uh, anybody else on this one. Council"},{"t":493,"text":"Coleman, go ahead. It's a fascinating one. I support this"},{"t":498,"text":"application. Um, what's lost for a number of people, I"},{"t":503,"text":"think, is the fact that here we have a private"},{"t":505,"text":"landowner saying they have a function that they no longer"},{"t":508,"text":"want to do, because it's too costly to renew. Um,"},{"t":512,"text":"and that's with respect to the parking function downtown. If"},{"t":515,"text":"we wanted, if Council wanted to protect that, we could"},{"t":519,"text":"purchase the property and then carry on as a parcade"},{"t":524,"text":"and have to go through the renewal costs. That's not"},{"t":527,"text":"what is in front of us. We appreciate the fact"},{"t":533,"text":"that this was originally a parcade that was supposed to"},{"t":536,"text":"support the old Eaton Centre, as it then was. Um,"},{"t":541,"text":"that world has changed. Is there a parking impact? Absolutely."},{"t":545,"text":"There will be. But the property owner wants to renew"},{"t":550,"text":"this in a different way. The application has been put"},{"t":552,"text":"in front of us. And I think as much as"},{"t":557,"text":"it's divisive, and I understand that, I think the application"},{"t":560,"text":"was thoughtful, the architecture was actually very good. And it"},{"t":565,"text":"is not much different in height and density than the"},{"t":569,"text":"building right across the street, which was. A bun fight"},{"t":573,"text":"12 years ago and is now seen as a vibrant"},{"t":577,"text":"part of downtown. So I think that this is part"},{"t":578,"text":"of the evolution. It's not about, um. Keeping the stasis"},{"t":585,"text":"in place, it's about allowing a development to come forward"},{"t":589,"text":"because a property owner says, I don't want to do"},{"t":591,"text":"that function anymore. I'm still supportive. Thank you very much."},{"t":595,"text":"Anybody else? I just will say that, uh, I supported"},{"t":599,"text":"this at committee. I will support it again today. For"},{"t":602,"text":"many of the reasons that previous speaker enunciated, but I"},{"t":606,"text":"do appreciate the reference to the bonfire 12 years ago."},{"t":609,"text":"It was indeed quite a controversial decision when we approved"},{"t":613,"text":"the sovereign. But I think it's true to say that,"},{"t":616,"text":"um, since that time it has become, um, a very"},{"t":619,"text":"welcome portion of that area of town with all of"},{"t":621,"text":"its residents. And, uh, parking is something that the next"},{"t":626,"text":"council is going to have to address. And there is"},{"t":628,"text":"existing direction to staff to explore that. And hopefully that"},{"t":631,"text":"will come to fruition in some way. But meanwhile, this"},{"t":634,"text":"is private property owner wishes to do something different with"},{"t":636,"text":"their private property. And so this seems to be meeting"},{"t":639,"text":"all of our policies and regulations around residential. So there"},{"t":642,"text":"you go. I'll be supporting this again today. Anybody else."},{"t":647,"text":"Although in favor, sorry, Councillor Loughton, did you want to"},{"t":650,"text":"speak? Yeah, go ahead. Through you, Mayor. I'm hesitant to"},{"t":655,"text":"do this because I don't want to take us backwards."},{"t":657,"text":"But I think some context around the rationale for the"},{"t":660,"text":"sovereign might help me right now. I've been really on"},{"t":662,"text":"the fence about this project. So how like, so, cause"},{"t":669,"text":"some of the arguments for 12 stories in Old Town"},{"t":672,"text":"was because we could, the comparison to the sovereign. So"},{"t":676,"text":"what were the concerns during the bunfight years ago? The"},{"t":682,"text":"Bonfi. Well, Councillor Coleman, I believe you were there at"},{"t":685,"text":"that time. Were you not? Yes, I think so. I"},{"t":687,"text":"think we both were. I think we both were. That's"},{"t":689,"text":"right. And so I would comment only that at the"},{"t":691,"text":"time, uh, as others have said in a variety of"},{"t":694,"text":"different applications in this term. Not that many years ago,"},{"t":699,"text":"a 12 story building seemed high. And certainly in the"},{"t":703,"text":"location of the current building, uh, that we're discussing as"},{"t":707,"text":"well as the neighbour of the sovereign just down the"},{"t":709,"text":"road. It was controversial in the sense that it was"},{"t":712,"text":"probably one of the first plus 10 story buildings in"},{"t":716,"text":"that area of town. At the time, as I recall,"},{"t":718,"text":"one of the most compelling rationales were both a design"},{"t":721,"text":"and the number of units. And the fact that it"},{"t":724,"text":"did bring, uh, quite remarkable housing to that area. And"},{"t":727,"text":"that was seen as a benefit because there are more"},{"t":729,"text":"residents. It did have a unique design in the way"},{"t":732,"text":"that it dealt with its own parking. And it did"},{"t":735,"text":"have a significant amount of design attention paid to a"},{"t":739,"text":"look that would not mimic. That's not appropriate. Not mimic"},{"t":743,"text":"old town, but at least be complementary to it. And"},{"t":746,"text":"so for all of those reasons and many more, those"},{"t":748,"text":"are just ones I remember off the top of my"},{"t":750,"text":"head. It was in fact endorsed and was built. And"},{"t":754,"text":"I think as others have noted, uh, it has become"},{"t":758,"text":"almost unnoticeable in the area. Although when it is noticed,"},{"t":762,"text":"it's often commented upon because of its design, which is"},{"t":764,"text":"quite interesting. And quite, I think, complementary, um, as we"},{"t":768,"text":"hoped it would be. So if you were asking a"},{"t":771,"text":"question about that decision, I think that's fair to say."},{"t":775,"text":"That's how that was decided. And I suspect for me"},{"t":778,"text":"similar analyses would go towards the current application. Okay. Thank"},{"t":781,"text":"you for that. Councillor Coleman. Did you want to add"},{"t":784,"text":"anything? Um, just that it also split council. It wasn't"},{"t":789,"text":"a unanimous endorsation. Of the project, the sovereign. It was"},{"t":795,"text":"contentious. We heard lots of voices on both sides of"},{"t":798,"text":"the argument as we have done with this. But it's,"},{"t":802,"text":"it's now seen as part of our old town fabric."},{"t":807,"text":"Um, so I, because you live through some of these"},{"t":810,"text":"things, you recognise that sometimes this is what, uh, evolution"},{"t":814,"text":"looks like. And recognise the application in front of us."},{"t":818,"text":"That we're now, it's brought back to us. Isn't the"},{"t":823,"text":"densest building in the precinct. It is not going to"},{"t":828,"text":"be the tallest, but it's close to it. It pushes"},{"t":832,"text":"the edge. And I understand people's concern. But I think"},{"t":834,"text":"that this is core revolution. Thank you. I appreciate that"},{"t":839,"text":"from our three UMA. I appreciate that. That's, that's helpful"},{"t":842,"text":"to have that historical background for me. Thank you. All"},{"t":845,"text":"right. It is before us. It has been moved in"},{"t":848,"text":"seconded. There is a multi ownership boutique near me."},{"t":923,"text":"And it works well. 24 - 7 staff on site,"},{"t":927,"text":"parking. It is small, but it has a small and"},{"t":931,"text":"very great restaurant with outside patio. So it is supposedly"},{"t":937,"text":"what this one pretends to be, but it actually has"},{"t":940,"text":"public amenity to it. And amenity for, um, for the"},{"t":945,"text":"people who are staying there. And I think that, uh,"},{"t":949,"text":"it would have been a good model. But it is"},{"t":951,"text":"not what's been done here. And this development's locking in"},{"t":955,"text":"many ways. Um, people aren't going to know whether it's."},{"t":960,"text":"Hotel or residential and trust seed a lot of CORs"},{"t":962,"text":"coming in. And I see this as actually a workaround"},{"t":967,"text":"of policies of the city. And adding to this unpalatable"},{"t":974,"text":"workaround is a loss of amenity, as I mentioned. For"},{"t":978,"text":"the shift of a density from one to two, and"},{"t":981,"text":"we lose 144, 000 dollars. And this development might even"},{"t":984,"text":"be able to apply for part of that 84 million"},{"t":988,"text":"dollar, you know, give away, uh, to the in tax"},{"t":993,"text":"to the hotel industry as they expand. And, uh, I"},{"t":997,"text":"think this is a very, very disappointing project. And I"},{"t":1002,"text":"believe the advisory panel was right when they said the"},{"t":1005,"text":"proposed development does not sufficiently meet the design guidelines and"},{"t":1008,"text":"should be declined. Actually, I did want to make one comment, which"},{"t":1014,"text":"is that I did receive a correspondence from the next"},{"t":1018,"text":"door neighbours of this proposed development, which is the midwifery"},{"t":1021,"text":"business, uh, immediately to the west that chairs a border"},{"t":1028,"text":"with this property. And they are enthusiastically supportive. They want"},{"t":1032,"text":"to see this property developed. And in fact, they've already"},{"t":1034,"text":"reached out to the developer to see if the possibility"},{"t":1036,"text":"to partner on a food truck or some kind of"},{"t":1038,"text":"activation and food for their clients and the folks that'll"},{"t":1041,"text":"be coming there. So the immediate neighbours are enthusiastically supportive."},{"t":1045,"text":"Thanks Mayor. Thank you very much. Anybody else. Our"},{"t":1089,"text":"September 24th Committee of the Holder was one item, which"},{"t":1091,"text":"was time sensitive. That was the Council Member motion, item"},{"t":1095,"text":"f1CA with regard to the commemorative signage, recognising the 100th"},{"t":1099,"text":"anniversary of the Royal Canadian Legion in order to ensure"},{"t":1102,"text":"that that is done prior to remember stay. That does"},{"t":1105,"text":"need same day consideration today. So I will move that"},{"t":1107,"text":"again. That's for a seconder. Oh, I'm sorry. Yes. For multiple addresses comprising the property at"},{"t":1284,"text":"Glenlion Norfolk School. It's the entire campus and it's located"},{"t":1288,"text":"in Gonzalez. You will note there's additional correspondence has been"},{"t":1294,"text":"added. It was received during the public consultation process and"},{"t":1298,"text":"it is attached. The rezoning proposal is for redevelopment of"},{"t":1304,"text":"the independent school, which proposes phased replacement. Of most of"},{"t":1309,"text":"the existing buildings and construction of approximately 15, 000 square"},{"t":1315,"text":"metres of institutional floor area, as well as approximately 16"},{"t":1320,"text":"ground oriented residential units. As noted in the update report,"},{"t":1324,"text":"the applicant has met the sole condition attached to council's"},{"t":1329,"text":"motion. And this was to strengthen heritage - related commitments."},{"t":1334,"text":"Uh, which would be established in the MDA. And brought"},{"t":1337,"text":"about through subsequent phases. There are also updates since council's"},{"t":1342,"text":"last considered this application. And I'll briefly go over them"},{"t":1344,"text":"now. First, your council report indicated that it was proposed,"},{"t":1352,"text":"um, from the applicant to create a comprehensive development zone."},{"t":1357,"text":"And so this would be added to the older, the"},{"t":1361,"text":"zoning regulation bylaw. However, during drafted and drafting and discussions"},{"t":1367,"text":"with staff, it was determined that fully transitioning this site"},{"t":1371,"text":"to the new zoning bylaw 2018 was both more efficient"},{"t":1376,"text":"and effective and given all properties are eventually to be"},{"t":1380,"text":"brought under the new bylaw over time. Second and more"},{"t":1385,"text":"related to the content. The draft permits a density of"},{"t":1390,"text":"0. 67 to one floor space ratio. And I would"},{"t":1395,"text":"note that your committee, the whole report, communicated the maximum"},{"t":1398,"text":"density would be set at marginally less at 0. 65"},{"t":1403,"text":"floor space ratio. This change was to accommodate and anticipated"},{"t":1408,"text":"increase in density when new buildings are constructed. And some"},{"t":1412,"text":"of the existing buildings are yet to be removed. Uh,"},{"t":1415,"text":"this is important to note that the school does intend"},{"t":1420,"text":"to operate throughout all phases. And so this was part"},{"t":1424,"text":"of making that possible without triggering a rezoning. Third, the"},{"t":1430,"text":"conceptual design showed a maximum building height of 14. 85"},{"t":1435,"text":"metres. And now this was based on a conceptual design,"},{"t":1438,"text":"of course. And this was for the larger school building."},{"t":1441,"text":"The applicant has proposed a change to their conceptual plans."},{"t":1447,"text":"So there is no change to what they're proposing at"},{"t":1449,"text":"this time, but has requested an increase in permitted height"},{"t":1453,"text":"to 18 metres. With discussions with staff concluded that the"},{"t":1458,"text":"flexibility would be supported, uh, as long as the applicant"},{"t":1463,"text":"agreed to. And they have to limiting the height to"},{"t":1467,"text":"11 metres along the properties edges. And only portions of"},{"t":1472,"text":"the school buildings that are at least 19 metres from"},{"t":1476,"text":"any property line, uh, would be permitted for that higher"},{"t":1479,"text":"height. This would ensure the reduced heights where our maintained"},{"t":1484,"text":"where they're near any type of, um, property boundary, which"},{"t":1488,"text":"is really the surrounding land uses was the consideration. So"},{"t":1492,"text":"if the application is approved today for third reading, staff"},{"t":1496,"text":"will proceed with the development of the required master development"},{"t":1499,"text":"agreement, which was outlined in your Committee the whole report."},{"t":1503,"text":"Thank you. It should solve"},{"t":1545,"text":"the drop off issue that we've heard a lot about,"},{"t":1548,"text":"uh, by moving things over to Richmond. It'll add a"},{"t":1551,"text":"lot of new trees and some incredible sustainability features. And"},{"t":1554,"text":"I just want to again, compliment the proponents by doing"},{"t":1558,"text":"such a good job of engagement. I think it was"},{"t":1561,"text":"a long and arduous process. Probably could have gone a"},{"t":1563,"text":"bit quicker. But I think they did a really good"},{"t":1565,"text":"job of building relative consensus in the neighbourhood and in"},{"t":1568,"text":"the community. And so I appreciate those efforts. So I'm"},{"t":1571,"text":"really happy to support this one moving forward. Thank you"},{"t":1573,"text":"very much. Councillor Kim. Anything to add anybody else? On"},{"t":1742,"text":"Madison Avenue, I understand that there will no longer be"},{"t":1744,"text":"vehicle access to the school for Madison street, or sorry,"},{"t":1748,"text":"Madison Street, not Madison Avenue. But does the plan also"},{"t":1752,"text":"prevent Madison from becoming an informal parent drop off and"},{"t":1756,"text":"pickup area? Or is that something the school will no"},{"t":1759,"text":"longer will have to manage operationally? Ms. Carroll. Through to"},{"t":1767,"text":"the mayor, there's nothing about this application or approval if"},{"t":1772,"text":"it was to go forward that would create a parking"},{"t":1776,"text":"change to the rules for parking along Madison. However, the"},{"t":1780,"text":"design I would emphasize that the design has been developed"},{"t":1786,"text":"to highly disincentivize the use of Madison and to incentivize"},{"t":1790,"text":"the use of Richmond and the primary, I would say"},{"t":1796,"text":"amenity that they're proposing is a pretty substantial drop -"},{"t":1799,"text":"off area along Richmond. So that would, uh, that would"},{"t":1803,"text":"do that. Also the through block, uh, driveway or drive"},{"t":1807,"text":"aisle is it does go through to the other side,"},{"t":1811,"text":"but it does not come out on to Madison. So"},{"t":1814,"text":"it pushes out on to Richardson. So, uh, we do"},{"t":1816,"text":"feel that the design does discourage, but it's not, it's"},{"t":1823,"text":"not preventing. Thanks. Um,"},{"t":1946,"text":"if we continue to see, um, problems or complaints from"},{"t":1951,"text":"residence, these are issues that would come back to us"},{"t":1953,"text":"as we currently deal with and respond to say on"},{"t":1956,"text":"Madison and the surrounding streets regarding traffic to the school."},{"t":1959,"text":"Um, so through this, we believe that where we've landed"},{"t":1964,"text":"is a good compromise and an improvement on the existing,"},{"t":1967,"text":"um, but it is possible that certain, you know, parents"},{"t":1970,"text":"or visitors will continue to use, uh, patterns that they've"},{"t":1974,"text":"been using already today. Today we"},{"t":2234,"text":"have one report before Council dealing with the appeal of"},{"t":2236,"text":"the denial of a business license for short - term"},{"t":2239,"text":"rentals. In April of 2020, Council approved the short -"},{"t":2242,"text":"term rental business license appeal process policy as part of"},{"t":2246,"text":"the evolution of the ongoing compliance monitoring with the City"},{"t":2249,"text":"short - term rental regulations by - law. The Community"},{"t":2252,"text":"Charter requires that anyone who's denied a business license has"},{"t":2255,"text":"the right to appeal the licensed inspectors decision to counsel."},{"t":2259,"text":"The City's policies, specific to short - term rental licences,"},{"t":2263,"text":"establishes a written submission process for both the appellant, the"},{"t":2266,"text":"operator of the short - term rental property, as well"},{"t":2268,"text":"as the City's license inspector. Council has one report today,"},{"t":2272,"text":"about one property for which a denial of the business"},{"t":2274,"text":"license for the short - term rental has occurred. Um,"},{"t":2603,"text":"at 742 AM and then also take runs around the"},{"t":2607,"text":"neighbourhood, um, after what seems like reasonable at work hours."},{"t":2610,"text":"So it just, um, the evidence of like inhabiting the"},{"t":2614,"text":"neighbourhood was I found compelling. Councillor Delay that you indicated"},{"t":2621,"text":"that you would be willing to move motion? Yeah. I"},{"t":2624,"text":"would move option one. Okay. We'll start with you."},{"t":2638,"text":"Sure. Um, these are really tricky cases with a lot"},{"t":2641,"text":"of evidence back and forth. And I do feel bad"},{"t":2644,"text":"for our staff who are tasked with trying to figure"},{"t":2646,"text":"out where these folks live. Um, I have reviewed the"},{"t":2650,"text":"file. And I think what our policies don't acknowledge is"},{"t":2654,"text":"that a lot of people in the city, young working"},{"t":2656,"text":"people, seniors, other folks don't live traditional lifestyles where they're"},{"t":2661,"text":"locked into one building seven days a week like I"},{"t":2664,"text":"am. People live, they travel. They do have multiple residences."},{"t":2667,"text":"This is a young fellow who works for a, not"},{"t":2671,"text":"necessarily a power line company, but he works around the"},{"t":2674,"text":"province, uh, he's been employed since 2017. We have a"},{"t":2677,"text":"letter from his boss saying he shipped out to these"},{"t":2679,"text":"various areas. And the telecommunications industry. And I think that's"},{"t":2683,"text":"reality for how some people want to live their lives."},{"t":2685,"text":"I don't want to be locked down with kids and"},{"t":2688,"text":"family and all that kind of stuff. And that's totally"},{"t":2690,"text":"fine. And our policies should not punish that. And I"},{"t":2693,"text":"recognise for staff that puts them in a hard position"},{"t":2695,"text":"trying to uphold those. I think it's actually a problem"},{"t":2698,"text":"with our policies that need to change. He's provided a"},{"t":2700,"text":"significant amount of evidence that all basically convert confirms that"},{"t":2705,"text":"at least on paper, this is a primary residence, um,"},{"t":2708,"text":"from, from tax receipts to driver's licences, to insurance to"},{"t":2712,"text":"every bill. And I understand that maybe, maybe he does"},{"t":2716,"text":"primarily live at other spots as part of his job."},{"t":2718,"text":"But this is the case he's making. And I think"},{"t":2721,"text":"our policies need to be a bit flexible for that"},{"t":2722,"text":"type of lifestyle. So I tend to sympathize with folks"},{"t":2725,"text":"who are that who are living that way and allowing"},{"t":2728,"text":"them to make some income off their house, well, while"},{"t":2731,"text":"they're not there. There's a specific focus on long -"},{"t":2734,"text":"term states. So at least folks are staying there for"},{"t":2736,"text":"30 days or 90 days, which is badly needed in"},{"t":2738,"text":"the city. But the bulk of the evidence, uh, for"},{"t":2741,"text":"me, I'm sympathetic to this. And I would grant the"},{"t":2743,"text":"reconsideration. Thank you very much. Councillor Kim. Secondary. I need"},{"t":2747,"text":"to add. Thanks to the chair. I would also add"},{"t":2750,"text":"that this appellant seemed, um, genuinely regretful of missteps they"},{"t":2756,"text":"had made in the past with licensing, um, technicalities. Um,"},{"t":2761,"text":"and you don't express regret. If it was done intentionally."},{"t":2768,"text":"So that was also quite compelling to me. Thank you."},{"t":2772,"text":"Anyone else on the option flirt Council Cardinal? Yeah. I"},{"t":2775,"text":"think I'll support option one as well. I think that"},{"t":2777,"text":"one of the pieces of evidence to suggest that it"},{"t":2780,"text":"was not a principal residence was the insurance type. Which"},{"t":2783,"text":"was listed as str, but the appellant I thought had"},{"t":2786,"text":"a compelling explanation of why they use that insurance type."},{"t":2789,"text":"It was on the advice of an accountant. And I"},{"t":2791,"text":"think it dated from a previous regulatory regime where, especially"},{"t":2796,"text":"in this building STRs were quite common. I was also"},{"t":2801,"text":"persuaded by the very large trove of documents attesting to"},{"t":2804,"text":"it being their principal residence. Haven't seen that much evidence"},{"t":2808,"text":"submitted before. And also the notion that this is the"},{"t":2811,"text":"only residence that they own. Because in some of the"},{"t":2815,"text":"other cases that we've looked at, someone owns a place"},{"t":2818,"text":"in Duncan and they own a place here and it's,"},{"t":2820,"text":"and it's sort of ambiguous about what their principal residence"},{"t":2822,"text":"is for this fill. This is the only place that"},{"t":2824,"text":"they own. It's possible that they're doing some kind of"},{"t":2826,"text":"rentals when they travel for work. But I, on balance"},{"t":2830,"text":"and looking at all the evidence, I'm convinced that this"},{"t":2832,"text":"is their principal residence and they just happen to live"},{"t":2834,"text":"a fairly itinerant lifestyle related to their work. So I'm"},{"t":2838,"text":"happy to grant the reconsideration. Thank you very much. Anybody"},{"t":2842,"text":"else. Nope. All right. And there were a couple"},{"t":2867,"text":"of pieces really missing for me. Um, but at the"},{"t":2871,"text":"same time, I recognise is what has been said is"},{"t":2874,"text":"this is really tough and it's tough for staff to"},{"t":2876,"text":"find the information. And, uh, remember this started from a"},{"t":2881,"text":"complaint from someone who lived there. And we've usually gotten"},{"t":2885,"text":"a couple other pieces of information in a lot of"},{"t":2887,"text":"the previous ones, which I can't mention because of course"},{"t":2889,"text":"we didn't get it. So, um, I just wanted to"},{"t":2892,"text":"say that and perhaps, um, we can look into that"},{"t":2895,"text":"later. And I think that new council, whoever the new"},{"t":2899,"text":"council isn't may be the same as this one. Maybe"},{"t":2901,"text":"has to look once again at our policy to try"},{"t":2904,"text":"and kind of smooth some things over. Thank you. Thank"},{"t":2908,"text":"you very much.
