But of course before we begin we always"},{"t":23,"text":"want to take a moment to ground ourselves and our"},{"t":26,"text":"work and a recognition and acknowledgement of the stewardship of"},{"t":30,"text":"these lands and the waters that surround them by the"},{"t":32,"text":"two nations on whose territories are City sits in its"},{"t":35,"text":"entirely. And in Tirity rather in the COSAP subnation and"},{"t":39,"text":"the Songs Nation. And as I'm sure as everyone is"},{"t":41,"text":"well aware there was a really remarkable event yesterday, hosted"},{"t":46,"text":"by the Songhees Nation, but on behalf of the South"},{"t":49,"text":"Island Nations. Not sure what the right verb there is"},{"t":54,"text":"there. Noting the National Day Recognition of Truth and Reconciliation."},{"t":60,"text":"And an opportunity for thousands of people to join together"},{"t":62,"text":"at Real Athletic Park to reflect and learn and observe"},{"t":68,"text":"and participate and have a conversations with many folks from"},{"t":71,"text":"a variety of different indigenous nations about their history and"},{"t":75,"text":"their resilience, their future. And a remarkable day it was"},{"t":80,"text":"indeed with so many different chances to see. And remember,"},{"t":85,"text":"I guess is the right way to put it. I"},{"t":88,"text":"don't know how many thousands of people were there yesterday."},{"t":90,"text":"I haven't seen the numbers, but I certainly know that"},{"t":91,"text":"in the time that I had the honour to be"},{"t":94,"text":"present, there were thousands without a doubt and it did"},{"t":97,"text":"seem that everyone was there with a good heart and"},{"t":99,"text":"an open mind and wanting to experience something unique. And"},{"t":102,"text":"so we thank the Songhees Nation in particular as the"},{"t":105,"text":"host, but all the nation who participated, some from very"},{"t":108,"text":"far away and some from quite nearby in making the"},{"t":111,"text":"day indeed memorable. It is just one example of the"},{"t":116,"text":"remarkable relationship that the City of Victoria has with the"},{"t":118,"text":"two nations in particular in talking about how we work"},{"t":122,"text":"together on a variety of different programs policies and endeavours."},{"t":128,"text":"One hopes and an informed and open - hearted way"},{"t":131,"text":"to ensure that we make the decisions the best we"},{"t":133,"text":"can for the people who have the privilege of living"},{"t":136,"text":"here in these lands. We always like to thank them,"},{"t":139,"text":"of course, in their language and the simplest of terms"},{"t":141,"text":"to say Hector Caseyama or Archkassium d'Aquilia, which is to"},{"t":143,"text":"say thank you and to express our gratitude and our"},{"t":146,"text":"respect for all of those people who have an opportunity"},{"t":149,"text":"to be here in these territories and who we hope"},{"t":152,"text":"will take a moment each day and do something that"},{"t":155,"text":"will bring a little joy to someone else in their"},{"t":158,"text":"lives. I should casse him, Nick Willia. I have no"},{"t":163,"text":"specific remarks to add today other than, as I noted"},{"t":166,"text":"earlier, that today as October 1st is the beginning of"},{"t":168,"text":"small business month, we have of course noted that in"},{"t":172,"text":"our proclamations as well as a request with a downtown"},{"t":174,"text":"Victoria Business Association and the Chamber of Commerce. And on"},{"t":178,"text":"behalf of the city, of course, looking to offer our"},{"t":181,"text":"thanks and gratitude and encouragement and support to the many,"},{"t":185,"text":"many, many small businesses that make up the hardware downtown"},{"t":187,"text":"in particular, but the heart of our community in general."},{"t":191,"text":"They are indeed unique and are one of the many"},{"t":192,"text":"things that draw visitors to the City of Victoria and"},{"t":195,"text":"also to reward our local residents for unique opportunities and"},{"t":201,"text":"unique experiences. And I always urge people to take the"},{"t":204,"text":"time to visit one of our small businesses and to"},{"t":207,"text":"support them and patronize them and make sure that we"},{"t":210,"text":"use them as they offer all the many different diverse"},{"t":213,"text":"opportunities for services and products and in relationships. Because without"},{"t":218,"text":"them, we will have a less exciting city. So happy"},{"t":224,"text":"to begin small business month for October and hopefully everyone"},{"t":226,"text":"will get out there and make sure that if they"},{"t":228,"text":"don't do it anyway, that they will make a special"},{"t":230,"text":"effort this month to support our small businesses. I'm not"},{"t":234,"text":"aware of any late items in our public agenda today,"},{"t":237,"text":"so I would look for someone to move a motion"},{"t":238,"text":"to approve the published agenda. Item G2, the Amendment Bylaw for"},{"t":262,"text":"the tenant protection during redevelopment process. And item G3 bylaw"},{"t":267,"text":"for advisory panels. I am aware that a Council member"},{"t":270,"text":"wishes to remove both item G1 and item G3, which"},{"t":275,"text":"would leave for consent only the item G2, the amendment"},{"t":278,"text":"Byle - off for Tena Protection Dream Redevelment. Does anyone"},{"t":281,"text":"wish to remove that one. Not seeing anyone wishing to"},{"t":285,"text":"do that, but someone liked to move the consent agenda"},{"t":287,"text":"being that one item. So we"},{"t":308,"text":"will move on to bylaws. The first up is G1."},{"t":313,"text":"This is the Amendment bylaw for 1276 - 1278 Gladstone"},{"t":317,"text":"Avenue. It's housing agreement. We have a report recommending first,"},{"t":321,"text":"second, and third readings of that housing agreement. Some would"},{"t":325,"text":"like to move that please. Thanks, Councillor Kim. Second of"},{"t":328,"text":"my Council Caradona. First, Councillor Kim, any comments. Called Security"},{"t":331,"text":"on any comments? Anybody else with any comments or questions?"},{"t":334,"text":"Go ahead, Councillor Gardner. Thank you. I have a couple"},{"t":336,"text":"questions. Um, I recall when this one came through, uh,"},{"t":340,"text":"so the amendment to the housing agreement, uh, 2 out"},{"t":344,"text":"of 18 units for 20 years. So what would be"},{"t":352,"text":"approximate dollar value of the 5 percent lower rental rate?"},{"t":356,"text":"And what is the daughter value of the tax exemption"},{"t":358,"text":"program that would be, uh, follow with this amendment. Who"},{"t":363,"text":"would like to take that question. Mr. Sauerd. Through the"},{"t":371,"text":"mayor, so the CMHC yourself, please. Oh, sorry. Through the"},{"t":378,"text":"manager of housing Ross Howard through the mayor, in terms"},{"t":382,"text":"of the rent rate that would be secured its 95"},{"t":387,"text":"percent of CMHC's median market rent. And so that would"},{"t":394,"text":"correspond to, um, approximately for like a one bedroom unit"},{"t":400,"text":"would be approximately just over 1, 500 dollars a month"},{"t":403,"text":"for a one bedroom unit. So the reduction would have"},{"t":406,"text":"been. Uh, well, the reduction would be in relation to"},{"t":410,"text":"whatever the market rent could be charged for that unit."},{"t":415,"text":"Bit five percent, okay. Through the mayor, no. So without"},{"t":421,"text":"the units being secured, uh, developer could charge market rent"},{"t":425,"text":"for that unit. We don't know exactly what that would"},{"t":428,"text":"be, but, uh, we're securing the CMHC median market rent"},{"t":434,"text":"and 95 percent of that. So it's probably somewhere in"},{"t":437,"text":"the neighbourhood of 30 percent below market. That's great news."},{"t":442,"text":"Well, it doesn't quote on to the question. And so"},{"t":444,"text":"what would be the dollar value of the tax exemption."},{"t":449,"text":"Mr. Source does something you would know or is that"},{"t":451,"text":"something I would look through? Uh, through the mayor, we"},{"t":453,"text":"would not have the amount until the building is completed"},{"t":459,"text":"and the full assessment value of the new building is"},{"t":463,"text":"on the record would be, I think, my understanding at"},{"t":465,"text":"this point in time. Stompson, did you want to add"},{"t":467,"text":"anything to that? Um, through you, Mayor and my colleagues"},{"t":472,"text":"here can correct me if I'm wrong, but I believe"},{"t":474,"text":"it, the exemption would be the incremental value only. The"},{"t":479,"text":"current value would stay, meaning that the proportion of the"},{"t":483,"text":"building that is currently taxed would continue to be taxed."},{"t":488,"text":"Thank you. Yeah, my apologies. I forgot"},{"t":501,"text":"that. I do have a question on this one that's"},{"t":503,"text":"similar to the one that was just posed. But when"},{"t":505,"text":"I first read this too, I did a double take"},{"t":507,"text":"because I thought that the RTE said that it's supposed"},{"t":513,"text":"to be. Now, is it 90 percent or 10 percent"},{"t":517,"text":"below 10 to 15 percent below market or something like"},{"t":519,"text":"that? But I feel like we're in a sense mixing"},{"t":522,"text":"up two metrics. There's one metric is X percentage below"},{"t":526,"text":"market. 10 to 15 percent. Which are two different metrics."},{"t":535,"text":"And I think that's maybe what we're getting confused about."},{"t":537,"text":"And so our, does our RTE bylaw specify which metric"},{"t":543,"text":"we're using. Mr. QSEC. To the mayor of units that"},{"t":551,"text":"are required to be secured as below market."},{"t":562,"text":"In the RTE Bylawlaw for the Affordable units, uh, we"},{"t":565,"text":"chose that amount because it reflects the affordability rates underlined"},{"t":571,"text":"in the housing strategy. But is able to be updated"},{"t":574,"text":"every year with the Semeat Seamarket rental report. Okay. Thanks,"},{"t":579,"text":"Sir clarifying that. And that's maybe a detail I missed."},{"t":581,"text":"It's just that for the average person and even for"},{"t":583,"text":"the average people around the table who are working on"},{"t":586,"text":"this stuff every month, it's a hard one to wrap"},{"t":589,"text":"your brain around. I mean, can we break that? I"},{"t":594,"text":"mean, what's the simple one or two sentence explanation for"},{"t":596,"text":"the public who is interested in actually untangling what that"},{"t":600,"text":"means. Mr. Seward through the mayor, um, so the CMHC"},{"t":606,"text":"every year does a rental market report. And as part"},{"t":609,"text":"of that rental marker report that gets published annually, they"},{"t":612,"text":"identify sort of the median market rate. So of all"},{"t":616,"text":"the buildings that get surveyed, they identify what's the sort"},{"t":618,"text":"of median rental rate for one bedroom, two bedroom, three"},{"t":622,"text":"bedroom. And so we've identified that that is a threshold"},{"t":627,"text":"that generally aligns fairly well with, uh, what something's affordable"},{"t":630,"text":"for someone who has a median income. And so we've"},{"t":633,"text":"pegged it to that. And then that number updates annually."},{"t":636,"text":"And then we've said 95 percent of that just to"},{"t":639,"text":"try to better calibrate to meeting incomes. Generally, I would"},{"t":642,"text":"say it equates to somewhere in the neighbourhood of around"},{"t":646,"text":"30 percent below market. Okay. For, yeah. And so that's"},{"t":650,"text":"the part that's sort of confusing because on the surface,"},{"t":654,"text":"it looks like it's five percent below market. But actually"},{"t":656,"text":"it's not five percent below market. But why is it"},{"t":660,"text":"30 percent below? Is it because the median, is it"},{"t":663,"text":"because we're making assumptions that landlords are charging at the"},{"t":667,"text":"upper end of CMHC average rents or something. Like help"},{"t":672,"text":"us understand that. Through the mayor, it includes the rental"},{"t":677,"text":"market report includes both units that have been occupied for"},{"t":680,"text":"a long time that would have been protected from rent"},{"t":684,"text":"increases from the provincial legislation through the RTA. And then"},{"t":689,"text":"it would also include units that are brand new that"},{"t":691,"text":"are in charging the whatever the highest rate that the"},{"t":696,"text":"market can afford. So, uh, we've used that threshold and"},{"t":700,"text":"we've identified that in the affordable housing standards bylaw. And"},{"t":703,"text":"so, uh, it's sort of a, it seems to be"},{"t":706,"text":"something that seems to be working for, um, kind of"},{"t":710,"text":"understanding from the market side, but it still aligns with"},{"t":713,"text":"our goals of supporting meeting income households. Okay. And so"},{"t":717,"text":"thank you for the clarifying that. So through the chair,"},{"t":719,"text":"is it broadly correct if the public assets to say"},{"t":723,"text":"that the RTE, in exchange for, um, attacks break or"},{"t":730,"text":"freezing the taxes. And so that they're not raising with"},{"t":732,"text":"whatever they would be after the rezoning. The proponents are"},{"t":736,"text":"offering 10 percent of the units at approximately 30 percent"},{"t":740,"text":"below market based upon the CMHC technical stuff, the 95"},{"t":745,"text":"percent of see MHC median, but approximately we're looking at"},{"t":748,"text":"about 30 percent below market rent. Mr. Sards through the"},{"t":753,"text":"matter. That's fair to say. Okay. Thank you. Very good."},{"t":756,"text":"Councillor Loughton. Sr. You Mayor. I just wanted to try"},{"t":760,"text":"mine here and just ask a question. The way that"},{"t":762,"text":"I typically describe this to people is it's, does that"},{"t":771,"text":"align? So if median income is safe, 55, 000 a"},{"t":776,"text":"year approximately, it would be 30 percent of that, sorry,"},{"t":781,"text":"pardon me. which also aligns with the CMHC average rental"},{"t":788,"text":"rate. Through the baron, based on your clarification, that's correct."},{"t":792,"text":"So the CMHC is used numbers are used so that"},{"t":796,"text":"it can move with the market. Okay. And then if"},{"t":801,"text":"I can just quickly add another question here, um, what"},{"t":805,"text":"is the average rental rate about a new one bedroom?"},{"t":809,"text":"So just so that we have a comparator. This is the Council"},{"t":911,"text":"meeting procedures, item 20. It has stated that parts, or"},{"t":915,"text":"sorry, under in here, uh, under meeting procedures, item 20"},{"t":921,"text":"in a state of the part six of the Council"},{"t":923,"text":"procedures bylaw applies to meetings of the advisory Heritage Panel."},{"t":927,"text":"Is there a meeting quorum set within this Section that"},{"t":931,"text":"applies to these panels. Just before you go on, Councillor"},{"t":936,"text":"Gardner, can you, um, are you looking at our procedures"},{"t":940,"text":"by law? Yeah. Well, perhaps, I know we didn't have"},{"t":944,"text":"a presentation on the changes here. Correct. I don't believe"},{"t":949,"text":"the presentation planned. This was just here for preliminary reading."},{"t":952,"text":"Yes. So I'm not looking for a full presentation. So"},{"t":954,"text":"I'm trying to shorten it where the letters or letter"},{"t":957,"text":"we got suggest that indeed that the new bylaw takes"},{"t":961,"text":"the work takes away quorum. Whereas the old one had"},{"t":965,"text":"quorum sets for these meetings. So I put my question"},{"t":968,"text":"to you actually as you reference the procedures. Yes. Because"},{"t":971,"text":"it's reference an item under meeting procedures under item 20"},{"t":976,"text":"of this document. It stated that part six of the"},{"t":979,"text":"Council procedures bottle applies to meetings of the advisory panel."},{"t":983,"text":"And so I'm wondering if there's a medium quorum set"},{"t":986,"text":"within that section that applies to these panels such that"},{"t":989,"text":"it can be deleted from this process. And I guess"},{"t":993,"text":"my puzzlement is that I'm looking at the procedures bylaw"},{"t":996,"text":"and I don't see that referenced in Section 6. No."},{"t":1002,"text":"Okay. So in Section 6, nothing about quorum. Okay. So"},{"t":1006,"text":"therefore it is not, so it has been removed from"},{"t":1008,"text":"quorum and therefore in these bylaws, correct? So there is"},{"t":1012,"text":"no quorum now. So Mr. Kingsley, can you help us"},{"t":1015,"text":"sort this out? Through you mayor. It's referencing part six"},{"t":1020,"text":"of the procedures bylaw. And part six is Section 38"},{"t":1025,"text":"following. And Section 38 has the, uh, citation for quorum."},{"t":1029,"text":"So it says a quorum for a standing selector advisory"},{"t":1032,"text":"committee is a majority of its members. And so that"},{"t":1034,"text":"applies now to the committee. So therefore it doesn't have"},{"t":1037,"text":"to be in this bylaws. Is that correct? If council"},{"t":1041,"text":"adopts this bylaw, it will, that will be the new"},{"t":1044,"text":"standard to apply to those two committees. Great. Correspondence, we also received also"},{"t":1056,"text":"spoke of the need for access to the advisory panel"},{"t":1058,"text":"meetings and transparency. And there was quite a bit in"},{"t":1063,"text":"description given in the correspondence that was provided to us."},{"t":1067,"text":"Uh, on Tuesday, I guess it was. And here's a"},{"t":1071,"text":"statement's made. Previous boylaw had committee reports coming to council"},{"t":1075,"text":"whereas this bylaw has reports going to the city. Does"},{"t":1078,"text":"this change reflect, um, the delegation bylaw where council is"},{"t":1083,"text":"cut off from many decisions? Or is there another reason"},{"t":1086,"text":"the reports may not be made public. Mr. Kingsley, is"},{"t":1089,"text":"this over to you as well? Uh, through you mayor."},{"t":1095,"text":"I'm happy to let planning staff advise on how they"},{"t":1098,"text":"anticipate this to work operationally. The bylaw itself, um, set"},{"t":1103,"text":"standards that meetings must be open to the public and"},{"t":1107,"text":"as well as a schedule posted. So the Byla certainly"},{"t":1110,"text":"contemplates that the meetings are supposed to be governed by"},{"t":1113,"text":"the same rules that governed council meetings as far as"},{"t":1115,"text":"openness transparency and council schedules published ahead of time. But"},{"t":1119,"text":"as for any specificity as to how this is envisioned"},{"t":1125,"text":"to operate, I would have to defer to planning staff"},{"t":1127,"text":"as to how they normally operate with the committees. Then"},{"t":1130,"text":"I will turn it to planning staff for some clarity."},{"t":1133,"text":"Hi. Through you, Mayor, my name is Laura Sretzki. I'm"},{"t":1136,"text":"Heritage Planner in Citywide Planning. Uh, the intent with the"},{"t":1139,"text":"bylaws is to maintain current practice where all the meetings"},{"t":1142,"text":"are open to the public. The schedule is posted on"},{"t":1145,"text":"the City website beforehand. Uh, the materials are posted on"},{"t":1149,"text":"the City website before the meeting as well. Um, and"},{"t":1153,"text":"all relevant items include a report. Any report to council"},{"t":1158,"text":"includes, uh, the minutes from the haplomate or AHP meeting,"},{"t":1163,"text":"uh, that was discussed at and their motion as well."},{"t":1166,"text":"And of course council is welcome to refer any item"},{"t":1169,"text":"at wishes to either panel, um, as well, uh, and"},{"t":1173,"text":"this is just really continuing practice as it has been."},{"t":1176,"text":"So still open to the public material is still available"},{"t":1178,"text":"to the public and communicating with council as we have"},{"t":1181,"text":"been. But is there any change to the"},{"t":1199,"text":"current practice or policy about how advice from any of"},{"t":1204,"text":"the committees then move forward. Because I believe there was"},{"t":1208,"text":"a concern about a change in terminology between Council to"},{"t":1212,"text":"the City. Which is less clear. Is there any change"},{"t":1217,"text":"and process? Thank you. No change in process. The city"},{"t":1221,"text":"has understood to include council as well. Heritage panel and advisory design"},{"t":1250,"text":"panel meetings are public meetings. And prior to 2020, members"},{"t":1253,"text":"of the public could easily attend by going to the"},{"t":1255,"text":"meeting. And with a switch to only online teams meetings"},{"t":1259,"text":"and online invitation must be requested and received for each"},{"t":1262,"text":"meeting. Thus reducing public attendance to only those with internet"},{"t":1267,"text":"access. And, uh, the person who wrote the email goes"},{"t":1271,"text":"on to say that, well, meetings are recorded. They aren't"},{"t":1273,"text":"posted. I mean, the videos aren't posted. Just a minute."},{"t":1277,"text":"Is that correct? It is correct that the recordings are"},{"t":1282,"text":"not at this time posted. Uh, we have moved to"},{"t":1286,"text":"a hybrid system, uh, which is enshrined in these bylaws,"},{"t":1291,"text":"uh, since 2020. Cause that was what the complaint was about"},{"t":1426,"text":"is that by going online and having to transact each"},{"t":1430,"text":"time, you can't do that if you're not really online"},{"t":1432,"text":"all the time. I don't think you usually get"},{"t":1442,"text":"20 people or 50 people at these meetings. So, um,"},{"t":1446,"text":"would it be possible in order to post online the"},{"t":1449,"text":"room number and that's what people can just turn up"},{"t":1451,"text":"rather than have to do a registration process for a"},{"t":1453,"text":"public meeting? They are often just"},{"t":1471,"text":"online even for panel members. They're not an important in"},{"t":1474,"text":"- person portion. But absolutely. We can change how we"},{"t":1479,"text":"run things for sure. So they aren't hybrid then. They"},{"t":1483,"text":"are often hybrid or just online. But no one knows"},{"t":1487,"text":"beforehand which is going to be. It depends on member"},{"t":1490,"text":"availability, um, currently our policy is that we can only"},{"t":1493,"text":"have an in - person meeting if there is quorum"},{"t":1495,"text":"in person in case technology fails us. Um, staffing and council consider"},{"t":2279,"text":"the OCP as a whole, um, when evaluating consistency of"},{"t":2283,"text":"any proposal with the OCP. Um, but we don't reattach"},{"t":2286,"text":"the entire plan that is considered, uh, to each report."},{"t":2290,"text":"Um, the recommendations of that report, uh, were consistent with"},{"t":2294,"text":"the OCP as a whole. Uh, this includes the OCPs"},{"t":2298,"text":"built form guidance and land use policies as well as"},{"t":2301,"text":"the economic development objectives. Um, the City action related to"},{"t":2305,"text":"strategic, um, sorry, strategies for a comic vitality and cultural"},{"t":2310,"text":"vibrancy was specifically called out, uh, in the OCP consistency"},{"t":2314,"text":"section of the report because it was the core driver"},{"t":2316,"text":"of bringing forward the, uh, economic and employment land solutions"},{"t":2320,"text":"report. Um, the recommendation for the zoning amendment before Council"},{"t":2325,"text":"today was also consistent with the OCP. That finding informed"},{"t":2329,"text":"the recommendation to waive the requirement for the public hearing."},{"t":2332,"text":"Um, for clarity, I will add the zoning amendment only"},{"t":2335,"text":"relates to old town with respect to proposing to add"},{"t":2339,"text":"light industrial laboratory and veterinary uses to the old town"},{"t":2342,"text":"district zone. Um, I understand the second question related to"},{"t":2347,"text":"the feasibility of a certain scale of hotel, uh, fitting"},{"t":2350,"text":"within the parameters of the old town district zone. Um,"},{"t":2353,"text":"first I'll just reiterate that the zoning amendment, uh, before"},{"t":2357,"text":"counsel does not involve changes to the height or density"},{"t":2360,"text":"permitted in the old town district one zone, um, there"},{"t":2363,"text":"are wide variety of hotel types and sizes that can"},{"t":2367,"text":"make sense to add in Victoria. Um, so these are"},{"t":2369,"text":"noted in the greater Victoria Hotel Development Report. Um, one"},{"t":2373,"text":"of these is a full service hotel with approximately 50,"},{"t":2377,"text":"000 square feet of floor area and about 150 rooms."},{"t":2381,"text":"And this was highlighted, um, as a hotel form that's"},{"t":2384,"text":"most likely to be viable given current conditions today. Um,"},{"t":2387,"text":"this scale of hotel informed the enabling zoning changes recommended"},{"t":2391,"text":"for the central business district zone. It is theoretically possible"},{"t":2396,"text":"that a 50, 000 square foot hotel could be compliant"},{"t":2399,"text":"with the longstanding height and density parameters of the old"},{"t":2403,"text":"town district zone. If it was on a site of"},{"t":2405,"text":"sufficient size, uh, and with the right conditions and context."},{"t":2409,"text":"Um, I should note, uh, context in any and all"},{"t":2412,"text":"development proposals would be subject to the applicable heritage conservation"},{"t":2415,"text":"area and development permit area guidelines. Um, and also boutique"},{"t":2420,"text":"and limited service hotels can be suitable for smaller scales"},{"t":2423,"text":"and smaller sites. And these also serve important roles within"},{"t":2427,"text":"Victoria. Um, I understand the third question related to whether"},{"t":2433,"text":"previously proposed policy changes to the downtown core area plan"},{"t":2437,"text":"would direct additional density to properties where no heritage merit"},{"t":2441,"text":"is identified. Um, those proposed policy updates were not advanced"},{"t":2445,"text":"by Council. Um, if the policy changes had been advanced,"},{"t":2450,"text":"they would not direct, uh, additional density to any given"},{"t":2453,"text":"site. Um, the policies would give the city updated guidance"},{"t":2456,"text":"for considering rezoning applications. If a hotel were to be"},{"t":2461,"text":"proposed on any given site. This would include guidance for"},{"t":2464,"text":"considering applications for more than three to one floor space"},{"t":2467,"text":"ratio, uh, for either existing heritage buildings or for properties"},{"t":2471,"text":"without heritage merit. And the proposed policies emphasized the rehabilitation"},{"t":2477,"text":"of existing heritage and making a positive contribution to the"},{"t":2481,"text":"existing heritage assets, uh, consistent with the heritage conservation area."},{"t":2486,"text":"Uh, again, to be clear, the proposed policy updates were"},{"t":2489,"text":"not advanced. And I guess at the"},{"t":2854,"text":"end of that, Council could consider, uh, collapsing that reserve."},{"t":2859,"text":"And to the chairs, I mean, I recall in our"},{"t":2861,"text":"conversations in months past that there's still some voluntary contributions"},{"t":2864,"text":"that could come in from, from, um, developers. And the"},{"t":2869,"text":"bonus density. And there's, I think hypothetically some scenarios in"},{"t":2872,"text":"which some CAC like, um, costs are still flowing to"},{"t":2877,"text":"the city. Is that not correct? Uh, through the mayor,"},{"t":2881,"text":"you know, the, the City does still continue to have"},{"t":2884,"text":"some ability to work with applicants through the rezoning process"},{"t":2890,"text":"to explore opportunities for voluntary contributions. And so in theory,"},{"t":2894,"text":"there could still be a trickle of revenue that comes"},{"t":2896,"text":"into the local amenity reserves, even though we're switching from"},{"t":2900,"text":"CACs to ACCs. So through the mayor, uh, yes, that's"},{"t":2906,"text":"correct. Okay. Uh, maybe I'll give some comments then. This"},{"t":2911,"text":"is one that I've been fighting for a while. If"},{"t":2914,"text":"you're called last year, we had a UBCM resolution. That"},{"t":2917,"text":"asked the province to reconsider how structured this program is."},{"t":2923,"text":"Because. It is, I mean, and correct me if I'm"},{"t":2926,"text":"wrong, Steph, because I always want to be factually correct,"},{"t":2928,"text":"but the, the previous regime, which was a bit the"},{"t":2932,"text":"wild west. I acknowledge. Whereas CACs were flying all over"},{"t":2936,"text":"the place. It did, the silver lining there was that"},{"t":2939,"text":"it gave local governments a lot of leeway in where"},{"t":2941,"text":"those developer contributions went. And one of the pathways of"},{"t":2946,"text":"those funds went into our housing reserve fund. Millions of"},{"t":2950,"text":"dollars went into the HRF, which we then repurposed into"},{"t":2954,"text":"non - market affordable projects. And also a lot went"},{"t":2957,"text":"into various kinds of infrastructure projects and other kinds of"},{"t":2960,"text":"unrestricted projects. And I lament the loss of that. And"},{"t":2963,"text":"I, I, I've tried to push back on that through"},{"t":2965,"text":"all the available channels over the last two years because"},{"t":2968,"text":"I saw the writing on the wall. And here we"},{"t":2971,"text":"are. And I do appreciate that ACCs are rationalizing something"},{"t":2976,"text":"that had been a Bit chaotic. But the problem is"},{"t":2978,"text":"that they're so structured in a way that the only"},{"t":2981,"text":"thing that developer contributions can go towards now are parks"},{"t":2985,"text":"or community spaces. And those are great things to invest"},{"t":2988,"text":"in. But there's other things to invest in, like non"},{"t":2991,"text":"- market affordable housing. And the other problem with the"},{"t":2993,"text":"ACC is that if I've understood it correctly of the"},{"t":2996,"text":"last couple of years, these projects have to be defined"},{"t":2998,"text":"ahead of time. It's not only they can just sit"},{"t":2999,"text":"around and you can use them later for some undefined"},{"t":3001,"text":"thing. They have to be X amount of dollars goes"},{"t":3004,"text":"to Y project. Or I don't know what happens. So,"},{"t":3008,"text":"um, I'm, I'm a bit fussed by this because I"},{"t":3011,"text":"do think it's going to impede our ability as local"},{"t":3014,"text":"government to invest or co - invest in non -"},{"t":3016,"text":"market affordable housing. By my tally, we've given 8. 5"},{"t":3019,"text":"million dollars projects this term. GVHS, CRHC, et cetera. That"},{"t":3025,"text":"money's now going to have to come from somewhere else"},{"t":3027,"text":"probably through tax or acquisition. Or something. But I did"},{"t":3032,"text":"think the sort of social democrat in me believe that"},{"t":3036,"text":"this was a really good redistribution of wealth. You're going"},{"t":3039,"text":"to build a condo. Okay. Some of those funds go"},{"t":3042,"text":"to the city. The city then uses them to support"},{"t":3044,"text":"people who are not as advantaged to live in a"},{"t":3047,"text":"luxury condo and need to live in non - market"},{"t":3049,"text":"housing. And so we've severed that tie now through procedural"},{"t":3053,"text":"changes that are essentially being thrust upon us by the"},{"t":3056,"text":"province. And again, I'm trying to be gracious to the"},{"t":3060,"text":"province and acknowledge that they're trying to rationalize something that"},{"t":3063,"text":"was a bit chaotic. But I think that there could"},{"t":3066,"text":"have been space left open for, first of all, affordable"},{"t":3069,"text":"housing. And second of all, a little bit more leeway"},{"t":3072,"text":"in giving some trust. To local governments that they're going"},{"t":3075,"text":"to invest in local amenities that are the best thing"},{"t":3078,"text":"for their community. So I am, I am fussed by"},{"t":3082,"text":"this. I don't see a reason to vote against it"},{"t":3083,"text":"because it's, it's provincial law and I don't want to"},{"t":3086,"text":"just be an obstructionist, but I do want to note"},{"t":3088,"text":"down that I do have serious misgivings about the structures"},{"t":3092,"text":"of ACCs. Uh, the primary tool that the"},{"t":3205,"text":"province has identified is really probably bonus density. So, uh,"},{"t":3209,"text":"based on, uh, there's opportunities for local governments to establish"},{"t":3215,"text":"bonus density schemes where cash contributions can be made. And"},{"t":3220,"text":"those cash contributions can then be made to an affordable"},{"t":3223,"text":"housing reserve that can then, you know, fund, uh, allow"},{"t":3228,"text":"for contributions to, um, nonprofit housing projects like we have"},{"t":3232,"text":"that in the past. So we do have, uh, that"},{"t":3234,"text":"ability in our, um, you know, our general residential areas"},{"t":3240,"text":"to make cash contributions to the density bonus. Um, but"},{"t":3243,"text":"certainly the landscape within the provincial with the new provincial"},{"t":3247,"text":"legislation has changed the way that the process will work"},{"t":3251,"text":"moving forward. Um, and is moving it more, um, into"},{"t":3256,"text":"a much more sort of structure density bonus approach. And"},{"t":3259,"text":"this new ACC bylaw approach. Okay. So just so I"},{"t":3262,"text":"understand this clearly then the bonus density, you can either"},{"t":3266,"text":"build that housing or is it like a cash and"},{"t":3269,"text":"lie. That's correct. Of creating those units that could go"},{"t":3274,"text":"into the housing reserve and then flow into non -"},{"t":3276,"text":"market projects. Okay. Thanks for that. Thank you. And as I've mentioned when we've"},{"t":3305,"text":"done this previously since this does place counsel in a"},{"t":3308,"text":"quasi judicial position, uh, unusually going to read a particular"},{"t":3313,"text":"script, uh, which has, um, particular language that is necessary"},{"t":3318,"text":"to ensure that our procedure is undertaken appropriately. So today"},{"t":3322,"text":"we have one report before council dealing with the appeal"},{"t":3325,"text":"of the denial of a business license for short -"},{"t":3328,"text":"term rentals at 1496 Dallas Road. In April of 2020,"},{"t":3333,"text":"Council proved the short - term rental business license appeal"},{"t":3335,"text":"process policy as part of the evolution of the ongoing"},{"t":3338,"text":"compliance monitoring with the City short - term rental regulations"},{"t":3342,"text":"bylaw. The Community Charter requires that anyone who has denied"},{"t":3346,"text":"a business license has the right to appeal the license"},{"t":3349,"text":"inspector's decision to counsel. The city's policy specific to short"},{"t":3353,"text":"- term rental licences establishes a written submission process for"},{"t":3356,"text":"both the appellant, who is the operator of the short"},{"t":3358,"text":"- term rental property, as well as the city's license"},{"t":3361,"text":"inspector. Council has one report today about one property for"},{"t":3365,"text":"which a denial of the business license for the short"},{"t":3367,"text":"- term rental has occurred. And again, that's at 1496"},{"t":3370,"text":"Dallas Road. I will now ask the City clerk to"},{"t":3373,"text":"give a brief overview of the process for the public"},{"t":3375,"text":"and for council. Mr. King's Lee. Thank you, Mayor. The"},{"t":3379,"text":"process begins when an application for a business license is"},{"t":3382,"text":"denied by a licensed inspector in writing citing the reasons"},{"t":3385,"text":"for the denial. The applicant indicates in writing that the"},{"t":3388,"text":"City clerk that they wish to appeal, the licensed inspector's"},{"t":3391,"text":"decision. The City cleric acknowledges the request and outlines the"},{"t":3394,"text":"appeal process. The applicant submits an appeal. The license inspector"},{"t":3399,"text":"provides a written submission. The applicant is offered the opportunity"},{"t":3402,"text":"to respond to the licensed inspector's submission. The City cleric"},{"t":3407,"text":"prepares a cover report attaching a submissions and process information"},{"t":3410,"text":"for councils consideration. And council considers whether to uphold the"},{"t":3414,"text":"license inspectors denial or overturn it. Only one bedroom is proposed for guests."},{"t":3563,"text":"And there is no cooking appliance under a bylaw definitions"},{"t":3566,"text":"that matters because a dwelling unit must include a kitchen"},{"t":3569,"text":"with a sink fridge and a stove hot plate microwave"},{"t":3572,"text":"air fryer toaster oven or other heating cooking appliance. On"},{"t":3576,"text":"this evidence submitted for 2026, the lower level has the"},{"t":3579,"text":"sink and fridge, but no cooking heating appliance. I don't"},{"t":3582,"text":"think it's fair to speculate what it could be put"},{"t":3584,"text":"into. Thank you, Councillor Dell is the secondary. Yeah, I"},{"t":3588,"text":"would like the clerk to pull up the photo I"},{"t":3590,"text":"sent, please. That's allowed it. Or permissions. Um, I guess"},{"t":3595,"text":"I'll speak as this. Like I look through the report,"},{"t":3598,"text":"um, I've looked through the unit, um, this looks like"},{"t":3602,"text":"part of a house where there's a tiny little, uh,"},{"t":3606,"text":"I don't even know what to call this. A T"},{"t":3608,"text":"making station. Essentially, uh, I understand there might be some"},{"t":3611,"text":"folks that want to live full time with, uh, tiny"},{"t":3614,"text":"little sink. And a kettle. Perhaps that can work for"},{"t":3619,"text":"some folks, but this is part of a house where,"},{"t":3621,"text":"uh, it's a very closely connected to a family's house."},{"t":3624,"text":"There's clearly kids, young kids living upstairs as shown in"},{"t":3626,"text":"the photos. Uh, this is not a long - term"},{"t":3629,"text":"rental suite. If someone could easily move into, uh, I"},{"t":3632,"text":"understand, it might be a kind of an in last"},{"t":3634,"text":"week, a sweet for friends or a short - term"},{"t":3635,"text":"rental spot. We're eventually a spot where this might be"},{"t":3638,"text":"turned into a TV room den for the kids and"},{"t":3640,"text":"another bedroom. But that kitchen does not meet the definition"},{"t":3644,"text":"of our bylaws. There's no stove there. There's no cooking"},{"t":3647,"text":"areas there. And I think therefore this is not the"},{"t":3650,"text":"intent of capturing what should be a long - term"},{"t":3654,"text":"rental. So this is what swayed me why I'm going"},{"t":3657,"text":"to be supporting number one. Thank you, Councillor Caradona on"},{"t":3659,"text":"number one. Yeah, I oppose and I think this is"},{"t":3662,"text":"a huge mistake to grant this reconsideration. There are hundreds"},{"t":3666,"text":"and hundreds of units just like this all across. The"},{"t":3668,"text":"entire city. Not units homes. Mainly basement suites that are"},{"t":3673,"text":"self - contained dwelling units. And if we allow this"},{"t":3677,"text":"one to be STR, it is going to stimulate many"},{"t":3679,"text":"others. To either not rent to renters or asset renters"},{"t":3684,"text":"to leave or whatever and shift into turning their homes"},{"t":3686,"text":"into quasi hotels. I'll read a portion of the inspector's"},{"t":3689,"text":"report. The appellant's appeal submission relies on the removal of"},{"t":3692,"text":"the connecting door. And that the basement food prep area"},{"t":3695,"text":"does not contain a cooking appliance. This is the same"},{"t":3698,"text":"position taken by the appellant in their 2025 appeal. The"},{"t":3701,"text":"only difference being that the door has now been removed"},{"t":3704,"text":"as opposed to simply being unlocked as was indicated last"},{"t":3707,"text":"year. The licensed inspector believes that despite the removal of"},{"t":3710,"text":"the connecting door and the cooking appliance, the appellant remains"},{"t":3713,"text":"able to offer the basement space as a self -"},{"t":3716,"text":"contained dwelling unit, separate from the appellant's principal residence on"},{"t":3719,"text":"the main and upper floors by simply replacing the removed"},{"t":3722,"text":"door in microwave. I'm sympathetic to homeowners who are trying"},{"t":3726,"text":"to find additional forms of income. I am absolutely sympathetic"},{"t":3730,"text":"to that, but I'm more compelled by the need to"},{"t":3733,"text":"retain our limited, more affordable housing stock. The short - term rental has provided"},{"t":3803,"text":"two advantages to the policy provided two advantage to homeowners"},{"t":3809,"text":"beyond the financial benefits. First, the flexibility to use the"},{"t":3812,"text":"area for family or guests. Second, lower risk. While most"},{"t":3816,"text":"tenants are absolutely great tenants, I once had to rent"},{"t":3820,"text":"out and grate tenants, but you get the one tenant"},{"t":3824,"text":"who might cause your life to be really upside down."},{"t":3828,"text":"And these are the two issues that really drive why"},{"t":3833,"text":"so many people are switching over, uh, their secondary suites"},{"t":3837,"text":"into short term. I don't like either. But what we"},{"t":3840,"text":"have before us is someone who has now complied with"},{"t":3844,"text":"the rules that were created. Thank you. I'm very close to going either way. What I"},{"t":3860,"text":"will say is that the approach that this motion takes"},{"t":3864,"text":"is that we're hoping Counsel is hoping for inspections and"},{"t":3868,"text":"enforcement. Because what we've got here is a situation where,"},{"t":3872,"text":"yes, appliances could be moved in quickly. The kitchen, while"},{"t":3879,"text":"small, could easily be built out. Um, the door can"},{"t":3884,"text":"just be placed back on its hinges. They're just sitting"},{"t":3886,"text":"there. So, uh, really what the appellant was saying was"},{"t":3892,"text":"that they would welcome enforcement. Um, I hope that we"},{"t":3896,"text":"are going to be doing that and inspecting. And if"},{"t":3900,"text":"we're not, then I am hoping that a staff are"},{"t":3903,"text":"going to tell us we don't have the resources to"},{"t":3905,"text":"actually inspect and enforce. Because if that's the case and"},{"t":3909,"text":"we're relying on inspection and enforcement for compliance, then we"},{"t":3913,"text":"are going to need to take a much stricter approach"},{"t":3915,"text":"in the future. So I will leave that comment with"},{"t":3919,"text":"staff, um, please. And please tell us if you're not"},{"t":3923,"text":"going to be able to inspect and enforce and we'll"},{"t":3926,"text":"have to be a lot more cautious in the future."},{"t":3929,"text":"Thank you.
