We"},{"t":10,"text":"are a full compliment in person today, which is nice"},{"t":12,"text":"to see. Today we have for a consideration two sets"},{"t":15,"text":"of minutes, two land use matters, one staff report, and"},{"t":20,"text":"one council member motion. But of course before we begin"},{"t":23,"text":"our work together, we always like to take a moment"},{"t":26,"text":"to reflect and ground ourselves in the reality of the"},{"t":29,"text":"privilege that we share to be here. And these spaces,"},{"t":33,"text":"and to do the work that we do and to"},{"t":34,"text":"live our lives on the territories of the LeQuang and"},{"t":36,"text":"people, the Song He's Nation and the Coast App Sub"},{"t":39,"text":"Nation, who have for so many generations taken the time"},{"t":43,"text":"and taking the responsibility so very seriously to be stewards"},{"t":46,"text":"of these lands and the waters that surround them. The"},{"t":50,"text":"two nations continue to do that work, and we're very"},{"t":52,"text":"privileged to be able to be partners with them, and"},{"t":54,"text":"some, and sometimes all of that work. And we want"},{"t":57,"text":"to ensure that every opportunity that we have to express"},{"t":60,"text":"our thanks to them and to acknowledge their work that"},{"t":62,"text":"we take, and also to note that as we continue"},{"t":65,"text":"our conversations with the two nations about so many different"},{"t":68,"text":"programs and projects and visions and possibilities that we do"},{"t":72,"text":"so with a very keen sets of gratitude and collegiality"},{"t":76,"text":"and an understanding that relationships at all points require nurturing"},{"t":80,"text":"and sustaining, and that there is work to be done"},{"t":83,"text":"on the part of every participant in that relationship. And"},{"t":86,"text":"so it's important for us always to start our days"},{"t":89,"text":"together by just remembering that that's where we are and"},{"t":93,"text":"paying a little homage and recognition to those folks and"},{"t":97,"text":"to remind ourselves that redesion we make. We hope reflects"},{"t":100,"text":"some of the good work that has been done already."},{"t":104,"text":"Faces of the very daunting challenges. They're ahead of us"},{"t":106,"text":"these days, but also an eye to the future, thinking"},{"t":110,"text":"that we are indeed building and rebuilding and renewing a"},{"t":114,"text":"city for everyone here now, but those who are coming."},{"t":118,"text":"With that, of course, we always say thank you in"},{"t":119,"text":"the language of the La Quang and Hedgesiam dekully, and"},{"t":122,"text":"that is just to say my respect to all of"},{"t":124,"text":"you who are here to the nations and their leadership,"},{"t":126,"text":"to the leadership on our communities, and to every person"},{"t":128,"text":"who chooses each day to spend a moment doing something"},{"t":131,"text":"good for someone else. This is the rezoning application and development"},{"t":223,"text":"permit with variances application for the property at 741 fistguard"},{"t":227,"text":"street. And I'm sure we have a number of staff,"},{"t":230,"text":"and we do here to help us work through this."},{"t":233,"text":"And so gentlemen, why don't you take your time to"},{"t":235,"text":"get yourself settled, and when you're ready, we'll hand it"},{"t":237,"text":"over to you."},{"t":250,"text":"Welcome. Good morning. Nice to see you. Good morning, Meralto."},{"t":255,"text":"Members of council. My name is Miko Batenzo, senior planner"},{"t":257,"text":"urban design with development services. I'm here with Jim Handy,"},{"t":261,"text":"our assistant director of planning. This is a rezoning and"},{"t":267,"text":"development permit with variants'application to construct a. 22 - story"},{"t":271,"text":"strata residential tower with ground floor commercial uses. The application"},{"t":275,"text":"also includes amendments to an existing master development agreement, or"},{"t":278,"text":"MDA, and the key considerations for council, are the proposed"},{"t":283,"text":"amendment to the MDA, which include permitting residential uses above"},{"t":287,"text":"the second floor, and to reduce the required amount of"},{"t":290,"text":"office space, and removing the historical requirement to certify the"},{"t":293,"text":"building as complying with lead silver standards. Development environment considerations"},{"t":298,"text":"include the application's consistency with design guidelines insofar as its"},{"t":302,"text":"form, character, landscaping, and design, and the impacts of the"},{"t":305,"text":"proposed variances, which include height, unit mix, and setbacks. The"},{"t":310,"text":"site is at the corner of Fisgard and Blanchard within"},{"t":313,"text":"the Downtown Corps, seen in this aerial slide. Uh, the"},{"t":317,"text":"subject property is currently a Surface parking lot. It was"},{"t":320,"text":"formerly a commercial building with Surface Parking, which was demolished"},{"t":323,"text":"in 2019. Moving to the site context, a neighbouring properties."},{"t":331,"text":"The site is surrounded by a mixture of commercial and"},{"t":333,"text":"residential buildings, uh, to the north. It's the image of"},{"t":337,"text":"the top left. That's the Hudson District, which is primarily"},{"t":340,"text":"residential with ground floor commercial uses. Across the street into"},{"t":343,"text":"the east is a small commercial building with Surface parking"},{"t":346,"text":"to the immediate west is a 10 - story office"},{"t":349,"text":"building. And then to the immediate South, again, we have"},{"t":352,"text":"a nine - story residential building, and that's the image"},{"t":354,"text":"in the bottom right - hand corner. The subject property"},{"t":358,"text":"is located within the Downtown Corps in the OCP Urban"},{"t":361,"text":"Structure Concept. And this area of the core anticipates the"},{"t":364,"text":"city's tallest buildings along the Douglas Blancherd and Yates corridors."},{"t":368,"text":"While the OCP does not specify maximum building heights or"},{"t":371,"text":"densities, the Downtown Corps area plan provides these details. Similarly,"},{"t":376,"text":"the OCP broadly supports a mix of employment and multi"},{"t":379,"text":"- unit residential uses, while the Downtown Corps area plan"},{"t":383,"text":"adds specificity as to where those uses are envisioned. Therefore,"},{"t":387,"text":"the proposal is consistent with the OCP. At 22 Stories,"},{"t":393,"text":"we're roughly 78 metres with a density of 7. 6"},{"t":396,"text":"to 1 FSR. The proposed building form and massing has"},{"t":399,"text":"been organised on the site to be consistent with the"},{"t":401,"text":"OCP's urban structure concept. This consistency supports the overall planning"},{"t":406,"text":"framework, which in turn creates a predictable investment ecosystem to"},{"t":409,"text":"support the city's overall developability and livability. Additionally, the proposed"},{"t":414,"text":"dentity is consistent with the existing zone, which the OCP"},{"t":417,"text":"notes as a consideration for assessing an application's consistency with"},{"t":421,"text":"the planned. As noted in the report before council, the"},{"t":425,"text":"existing zone was part of a rezoning in 2007, which"},{"t":429,"text":"sought to permit a 15 - story commercial building on"},{"t":431,"text":"the subject property. At the time of that rezoning, density"},{"t":435,"text":"bonus regulations were established, as well as the master development"},{"t":438,"text":"agreement with the MDA to secure at least 60 percent"},{"t":441,"text":"of the total floor area for office space, as well"},{"t":444,"text":"as a number of other amenities. Uh, which are outlined"},{"t":447,"text":"in the current zoning. Uh, and these were in exchange"},{"t":450,"text":"for the increased density of up to 7. 6 to"},{"t":452,"text":"one FSR. And so the current application is consistent with"},{"t":456,"text":"the density bonusing provisions in the existing zone. As such,"},{"t":461,"text":"the proposed density is supportable. Further considerations to assess the"},{"t":466,"text":"proposed height, direct us to the DCAP map 29, and"},{"t":470,"text":"you'll note for this area, the anticipated building height is"},{"t":473,"text":"up to 24 stories or 72 metres, and again, the"},{"t":476,"text":"proposal is for 22 story building at 78 metres, or"},{"t":480,"text":"6 metres higher than what the decap envisions. This inconsistency"},{"t":484,"text":"is mitigated by utilising a smaller floor plate than what's"},{"t":488,"text":"envisioned within the design guidelines. As such, the proposal is"},{"t":491,"text":"for a slightly taller but narrower building. Uh, and just"},{"t":496,"text":"sort of generally makes the height consistent with what we'd"},{"t":498,"text":"expect and the variance for the height as well. Uh,"},{"t":502,"text":"moving into the downtown core area plan, uh, looking for"},{"t":506,"text":"looking at land use, um, the OCP is broad in"},{"t":509,"text":"terms of land use, but decap indicates that this area"},{"t":512,"text":"is intended to serve as the Central Business District, which"},{"t":514,"text":"primarily seeks to limit residential use and to prioritize commercial"},{"t":518,"text":"uses, as shown in this map. Uh, and this is"},{"t":522,"text":"the Central Business District, all the area highlighted in red,"},{"t":525,"text":"and obviously the big red arrow is our site. Now"},{"t":529,"text":"looking a little bit more closely, some of the key"},{"t":531,"text":"policies within the Central Business District include concentrating commercial uses"},{"t":535,"text":"and limiting residential uses to a maximum of three to"},{"t":538,"text":"one FSR. And as a reminder, and to offer a"},{"t":540,"text":"bit of a clarification, the existing zone does not limit"},{"t":543,"text":"the amount of residential density permitted beyond the existing zone"},{"t":547,"text":"density, which is 7. 6 to one FSR. And the"},{"t":550,"text":"proposal is for 7. 6 to one FSR, and the"},{"t":552,"text":"residential portion of that is 5. 8 to one FSR."},{"t":558,"text":"Council, however, is considering if the MDA should be amended"},{"t":561,"text":"to reduce the requirement for office use and to increase"},{"t":563,"text":"the permitted density of residential use. Given the focus in"},{"t":567,"text":"the OCP to address the housing crisis within the framework"},{"t":569,"text":"of the urban structure concept, the subject site presents as"},{"t":573,"text":"a candidate to consider increased residential use. The factors that"},{"t":576,"text":"make this site a candidate include its underlying zoning, its"},{"t":580,"text":"consistency with the urban structure concept, and its proximity to"},{"t":583,"text":"other residential uses. So what this slide shows, and I"},{"t":586,"text":"can flick back and forth, is just the amount of"},{"t":589,"text":"the core business district that already contains residential uses. And"},{"t":593,"text":"so these areas are all highlighted in yellow. And in"},{"t":596,"text":"most cases, those residential uses existed prior to the policy"},{"t":599,"text":"update that sought to reserve city lands for commercial uses."},{"t":603,"text":"So looking at this slide, it's noted that the majority"},{"t":605,"text":"of the block that contains the subject site is already"},{"t":608,"text":"occupied by residential uses, and in general terms, the area"},{"t":611,"text":"of the Central Business District North of Quoront is largely"},{"t":614,"text":"residential. So this makes for a bit more of a"},{"t":617,"text":"contiguous residential area. To consider some of the development permit"},{"t":622,"text":"issues, this slide shows the site plan, the ground floor"},{"t":627,"text":"plan is a bit clearer, and it shows the statutory"},{"t":630,"text":"right away on the left - hand side of the"},{"t":632,"text":"image there, uh, running along the western boundary. This SRW"},{"t":636,"text":"was secured as part of the previous MDA, and it's"},{"t":639,"text":"proposed to be completed as part of this application, constructing"},{"t":642,"text":"that stature right of way was also part of the"},{"t":645,"text":"bonus density conditions. Um, other aspect of the proposal illustrated"},{"t":651,"text":"on this plan include the large plaza area in the"},{"t":654,"text":"northeast corner. Um, the frontage improvements beyond bylaw requirements. And"},{"t":659,"text":"so this includes a boulevard rain gardens on Blanchard and"},{"t":662,"text":"Thysgard, and the extended median just at the bottom right"},{"t":664,"text":"hand. You can see how the medium goes beyond the"},{"t":666,"text":"sight boundaries. So those are all conditions that are secured"},{"t":669,"text":"within legal agreements, and the recommended motion to counsel includes"},{"t":674,"text":"wording to that effect. Uh, you can also see the"},{"t":678,"text":"commercial retail units, um, at grade here. And so those"},{"t":681,"text":"are along Blanchard and Fizzguard, and then there's also these"},{"t":684,"text":"very small commercial retail units running along the Statutory right"},{"t":687,"text":"- of - way. Uh, and that's sort of a"},{"t":689,"text":"bit of a novel approach to commercial retail units, uh,"},{"t":691,"text":"just something to consider an association with this application. Moving"},{"t":698,"text":"to the floor plan for floors two and three, I"},{"t":701,"text":"can speak about the first variant for council's consideration, so"},{"t":704,"text":"it's along at the bottom of the image here, the"},{"t":706,"text":"southern boundary. And so that variance is reducing the setback"},{"t":710,"text":"from eight metres to 0. 3 metres. And the thing"},{"t":714,"text":"to point out on this plan is that that 0."},{"t":716,"text":"3 metres is to the patio area itself. The actual"},{"t":719,"text":"building is 5. 5 metres from the property line. So"},{"t":723,"text":"it's sort of less of an impact than sort of"},{"t":726,"text":"anticipated than what the number might indicate. Um. I'll just"},{"t":732,"text":"return to this in a second, but I just want"},{"t":733,"text":"to move to the third floor, and the roof, or"},{"t":735,"text":"the fourth floor rather, and the roof of the third"},{"t":737,"text":"floor. And so, uh, this is the key amenity area"},{"t":741,"text":"for the building. There's a mixture and hard and soft"},{"t":744,"text":"landscaping features on the rooftop level, and the entire fourth"},{"t":747,"text":"floor interior is dedicated to amenity and office space. So"},{"t":750,"text":"there's a 1200 square foot shared working space for Busing"},{"t":753,"text":"Residence, a sound studio and a fitness space on this"},{"t":756,"text":"level. Moving back to the setback variances, and so here"},{"t":761,"text":"you can actually see how those setbacks actually work. So"},{"t":763,"text":"the setback to the podium is 5. 5 metres, and"},{"t":766,"text":"the setback to the tower is 8 metres. Uh, and"},{"t":769,"text":"so that tower setback is a reduction from 10 to"},{"t":772,"text":"8 metres. Um, and then I'll just speak to the"},{"t":775,"text":"podium variance. So this image shows an aerial view of"},{"t":778,"text":"the existing site conditions, which have influenced the recommendation to"},{"t":780,"text":"support this variance. The building to the South is located"},{"t":784,"text":"about 12 and a half metres away from the property"},{"t":786,"text":"line, and redevelopment of this parcel is unlikely giving the"},{"t":789,"text":"properties age. As noted, the actual residential units are 5."},{"t":794,"text":"5 metres set back from the property line, making the"},{"t":796,"text":"separation between the buildings roughly 18 metres. The separation distance"},{"t":800,"text":"is generally consistent with our policy. The challenge is that"},{"t":804,"text":"to gain this separation distance, the subject site relies on"},{"t":807,"text":"its neighbor's airspace, which policy generally discourages. That said, looking"},{"t":812,"text":"at the existing site conditions, the fact that this variance"},{"t":815,"text":"is only relevant for floors two and three, and the"},{"t":818,"text":"likely redevelopment scenarios for the adjacent property. This variance is"},{"t":821,"text":"recommended as supportable. Moving into the tower floor plans, the"},{"t":826,"text":"variety of layouts that you'll see in the next few"},{"t":828,"text":"slides, um, the aspects to draw council's attention to include"},{"t":832,"text":"the sky gardens. So these are proposed on floors 7,"},{"t":836,"text":"9, 12, 17, and 19, as well as at the"},{"t":838,"text":"penthouse for a total of six sky gardens, not including"},{"t":841,"text":"the penthouse sky gardens. And these all range in size"},{"t":844,"text":"from about 600 to 700 square feet. Additionally, as noted"},{"t":848,"text":"in the applicant's letter, there are dedicated work from home"},{"t":851,"text":"spaces within each unit type. So I'll just sort of"},{"t":853,"text":"flip through these. Not that they're completely discernible at that"},{"t":857,"text":"scale. Um, once we get to, oh, so here's, just,"},{"t":864,"text":"I need to mention this as well. So once we"},{"t":865,"text":"get to the Penteus level, uh, which is this level,"},{"t":868,"text":"the floor plate reduces in size, and the three distinctive"},{"t":871,"text":"sky gardens that define the level. I should also mention"},{"t":874,"text":"the unit mix variances at this stage. And there is"},{"t":877,"text":"a correction in the motion that's recommended to counsel. So"},{"t":880,"text":"right now the motion says that the three bedroom units"},{"t":884,"text":"are being reduced from 10 to three, and the two"},{"t":886,"text":"bedroom units from 20 to 15. There should be a"},{"t":889,"text":"percentage sign with each of those figures. So correct in"},{"t":895,"text":"the body of the report, just not in the motion."},{"t":898,"text":"And I can make that recommendation again if once the"},{"t":900,"text":"motion comes up. Um, so that means that the actual"},{"t":904,"text":"three bedroom units are being reduced from 16 to six,"},{"t":907,"text":"and the number of two bedroom units are being reduced"},{"t":909,"text":"from 31 to 24. So these variances are also recommended"},{"t":912,"text":"to be supported, because this application came in prior to"},{"t":916,"text":"the enactment of the family housing unit mix requirements. Um,"},{"t":920,"text":"and so the applicant did attempt to, uh, increase the"},{"t":923,"text":"number of family units. And so they went from having"},{"t":926,"text":"zero three bedroom units to actually six, three bedroom units."},{"t":929,"text":"And I believe, uh, four additional two bedroom units were"},{"t":932,"text":"added since that enactment came through. And so, you know,"},{"t":937,"text":"largely that the design was complete. And so, uh, it"},{"t":939,"text":"was deemed at further changes to meet the actual housing"},{"t":942,"text":"unit mix. We're not feasible. Uh, looking quickly at the"},{"t":948,"text":"Section View, you can see that there are four levels"},{"t":950,"text":"of underground parking, which provide a total of 140 parking"},{"t":953,"text":"stalls. Uh, this is consistent with the zone requirement and"},{"t":956,"text":"noting that there are 156 residential units. Moving to the"},{"t":960,"text":"elevations, this is the South and West elevation. You can"},{"t":963,"text":"see the four sky gardens facing south, not including the"},{"t":967,"text":"penthouse sky gardens. Uh, looking at the north elevations, sky"},{"t":971,"text":"gardens facing north, keeping in mind that they're also open"},{"t":973,"text":"to the east and west. Um, looking at the building"},{"t":978,"text":"elevations within the street context, so the upper image is"},{"t":981,"text":"looking south with the building fronting onto Fizzgaard, the bottom"},{"t":984,"text":"image is looking west with the Hudson District on the"},{"t":987,"text":"right to the north. And it's evident that while this"},{"t":989,"text":"proposal is for a tall building, it is consistent with"},{"t":991,"text":"the urban structure concept. And both complements and fills in"},{"t":994,"text":"the city skyline consistent with the urban amphitheater goals. This"},{"t":998,"text":"is a view analysis. This is sort of taken from,"},{"t":1000,"text":"you know, bird's eye view. And so typically, and you"},{"t":1003,"text":"can see in the middle of the screen there, that"},{"t":1005,"text":"is the proposal. Um, typically we look for this analysis"},{"t":1008,"text":"to be taken from the ground view. And so this"},{"t":1010,"text":"would be that ground view from the Song He's Vantage"},{"t":1014,"text":"Point. And I don't know if the, it's the building"},{"t":1017,"text":"is continually being referred to as gateway green, but it's"},{"t":1021,"text":"labelled on this plan as gateway green. But that's the"},{"t":1023,"text":"proposed building. And so you can see it sort of"},{"t":1025,"text":"fits with that general urban structure and the urban amphitheater"},{"t":1027,"text":"concept as well. Uh, moving to the shadow study, the"},{"t":1031,"text":"proposal does have shadowing impacts. It's noted that these are"},{"t":1034,"text":"less than what would be permitted on the site now"},{"t":1037,"text":"with 15 - Story office building. So because we have"},{"t":1040,"text":"a podium and tower, uh, distribution of density, we actually"},{"t":1043,"text":"have a narrower building and less of a shadowing impact."},{"t":1047,"text":"And it would be consistent with our policy from that"},{"t":1049,"text":"respect. Moving to the landscape plan, uh, I can just"},{"t":1053,"text":"briefly point out, we've got rain gardens. There's a large"},{"t":1055,"text":"public plaza area in the northwest corner or northeast corner."},{"t":1060,"text":"And we have our SRW on the, um, uh, Western"},{"t":1062,"text":"property line. Landscaping is also proposed on that third floor"},{"t":1066,"text":"rooftop level. And then these are the sky gardens throughout"},{"t":1070,"text":"the site. Each of them, uh, around 600, 700 square"},{"t":1074,"text":"feet rather. And this is sort of amenity space for"},{"t":1077,"text":"all of the residents of the building. I'll flick through"},{"t":1081,"text":"some renderings really quickly here in case there's any questions"},{"t":1083,"text":"about, you know, how that the building is perceived. You"},{"t":1087,"text":"know, looking, it's best to look at the street level"},{"t":1091,"text":"views, um, and you can see, uh, sort of how"},{"t":1094,"text":"that building relates to its general context. Material board, I"},{"t":1099,"text":"can answer questions on materials. Should there be any. And"},{"t":1102,"text":"then I'll just conclude with, you know, the proposalists were"},{"t":1104,"text":"a 22 story residential tower with ground four commercial uses."},{"t":1108,"text":"It's generally consistent with the OCP's urban structure concept and"},{"t":1111,"text":"anticipated downtown urban form. The proposal also offers amenities required"},{"t":1117,"text":"as part of the density bonus conditions within the existing"},{"t":1119,"text":"zone. And therefore, its density is consistent with the zone."},{"t":1123,"text":"While the proposed amount of residential use is inconsistent with"},{"t":1125,"text":"the use goals and objectives of the downtown core area"},{"t":1128,"text":"plan, the underlying entitlements within the zone, the density bonus"},{"t":1133,"text":"provisions, continuity with other residential areas and the OCP's flexibility"},{"t":1137,"text":"around use make this application a reasonable candidate to consider"},{"t":1141,"text":"for increasing the amount of residential use within an area"},{"t":1144,"text":"of the city primarily envisioned to support employment uses. For"},{"t":1147,"text":"these reasons, the proposed changes to the MDA are supportable"},{"t":1150,"text":"and the application is recommended for support. Thank you. Thanks for the presentation."},{"t":1171,"text":"Um, I just have a couple of questions. It's been a"},{"t":2142,"text":"bit on hold because of financial constraints, but it's still"},{"t":2146,"text":"in our long - term plans to turn that into"},{"t":2147,"text":"a park. And I think maybe this 250, 000 dollars"},{"t":2150,"text":"helped get us there. There's certainly going to be people"},{"t":2152,"text":"own dogs in this building. And so it's, it's an activated"},{"t":3175,"text":"space. It has an active entrance into the, uh, bike"},{"t":3179,"text":"lockers as well or sort of the long - term"},{"t":3181,"text":"bike parking. And then it has the sort of food"},{"t":3183,"text":"court type quality about it so that it's activated and"},{"t":3187,"text":"benefits from that passive surveillance, uh, with the activity along"},{"t":3190,"text":"there. I think it's a huge"},{"t":3197,"text":"win for finishing that, uh, the, um, the connector between"},{"t":3203,"text":"CORMA and Fisgard and also a place of activation, which"},{"t":3207,"text":"is great for downtown. And while that's being pulled"},{"t":3327,"text":"up, I'll just motivate generally and say that this file"},{"t":3332,"text":"has been a long haul. And I appreciate that the"},{"t":3335,"text":"proponents have stuck with it. There was a previous concept"},{"t":3338,"text":"here that would have had much more, uh, office space."},{"t":3342,"text":"And as we all know, the demand for office space"},{"t":3345,"text":"has really created in recent years. So it's probably a"},{"t":3348,"text":"good thing that we didn't end up with another office"},{"t":3350,"text":"tower here that probably would have had really soft demand."},{"t":3353,"text":"Um, I think this is the right location for 22"},{"t":3355,"text":"stories, 156 stratified units is welcome. I saw snarky comment"},{"t":3361,"text":"online the other day. I know on the internet of"},{"t":3363,"text":"all places, right? Um, referring to all the condo buildings"},{"t":3367,"text":"that are being built aroundwn. And I stopped and thought,"},{"t":3370,"text":"what condo buildings? Uh, if you think about all the"},{"t":3373,"text":"construction that's going on around the city, it's basically all"},{"t":3376,"text":"either market rental or non - market rental or a"},{"t":3378,"text":"combination of two. Harris green, the charred arise, all those"},{"t":3383,"text":"projects that are being built downtown are rental because we"},{"t":3386,"text":"didn't build rental in this city for basically 30 years."},{"t":3388,"text":"There's not a lot of large stratified projects in the"},{"t":3391,"text":"works at all. The only one I can think of"},{"t":3392,"text":"off the top of my head is the chard project"},{"t":3395,"text":"on Celladonia Douglas that has a non - market rental"},{"t":3399,"text":"and anacondo tower. That's the only one off top of"},{"t":3401,"text":"my head I can think of. All the rest of"},{"t":3403,"text":"the Shotify development that's going on in the city is"},{"t":3405,"text":"happening in residential neighbourhoods because we've successfully changed the policies"},{"t":3409,"text":"to encourage more stratified housing in residential areas in smaller"},{"t":3413,"text":"buildings that are ground oriented, which is where most people,"},{"t":3417,"text":"especially families, want to live. Not all, but most. That"},{"t":3420,"text":"said, there still is some demand for downtown stratified living."},{"t":3424,"text":"And we haven't overbuilt on condos in this term. What"},{"t":3428,"text":"we've been catching up on is market and non -"},{"t":3430,"text":"market rental. So it, but we still need to be"},{"t":3432,"text":"building stratified. If there's one misgiving I have going previous"},{"t":3437,"text":"comments is around the Family Housing bylaw. It's not a"},{"t":3440,"text":"policy anymore. It's now regulation. But I do accept that"},{"t":3443,"text":"this project was in stream. I also accept that the"},{"t":3446,"text":"demand for family housing downtown is probably a little bit"},{"t":3450,"text":"softer. Downtown that it is in residential neighbourhoods. All the"},{"t":3453,"text":"first missing middle buildings that have been built and sold"},{"t":3456,"text":"in the last year and a half or so. And"},{"t":3458,"text":"I pay really close attention to this. Uh, the family"},{"t":3461,"text":"housing units are selling. The two and three bedrooms are"},{"t":3464,"text":"selling because there's demand for ground oriented stratified housing. I"},{"t":3466,"text":"don't know if there's enough, if the demand downtown, I'd"},{"t":3470,"text":"like maybe at some point to hear from staff about"},{"t":3473,"text":"that maybe when the decap analysis comes back and maybe"},{"t":3476,"text":"we, we tweak our policies or something, but that's a"},{"t":3478,"text":"conversation for a different day. But for today, I recognise"},{"t":3480,"text":"that this project was in stream, but there still will"},{"t":3484,"text":"be some, some two and three bedrooms. And so that's"},{"t":3486,"text":"good. The amenities have already been spoken to. They're phenomenal"},{"t":3489,"text":"amenities. The piece I want to attract attention to is"},{"t":3492,"text":"the top right image. It's a little bit small. I"},{"t":3495,"text":"don't know if we can zoom in on it. It"},{"t":3497,"text":"floated under the radar a bit in the staff report,"},{"t":3500,"text":"but yeah, to the right. The idea there is to"},{"t":3503,"text":"have this cool little alleyway that goes between this building"},{"t":3507,"text":"and the building to the West with at least two"},{"t":3510,"text":"or possibly three CRUs along there. I just got back"},{"t":3514,"text":"from a trip to Japan in March with my family"},{"t":3517,"text":"and it reminds me a lot of these narrow alleyways"},{"t":3519,"text":"in Japan where you have these small little restaurants that"},{"t":3521,"text":"activate the street and create these little nooks and crannies"},{"t":3525,"text":"that people can gather in. So I think that's going"},{"t":3526,"text":"to be a really big addition to this neighbourhood here."},{"t":3530,"text":"This is still a neighbourhood that's in the process of"},{"t":3532,"text":"becoming something, right? It's, it's still kind of its character"},{"t":3535,"text":"is still coming into being. Eventually the cool park across"},{"t":3538,"text":"the street hopefully with a little dog run. I think"},{"t":3540,"text":"the housing and the street activation here will help. It'll"},{"t":3543,"text":"complement what's nearby at the HUDS and District. So I"},{"t":3546,"text":"really like that little alley and I thought it was"},{"t":3548,"text":"worth a tracking attention to it. So the design here"},{"t":3551,"text":"is superb. The housing is needed. The 450, 000 dollars"},{"t":3556,"text":"going towards the park and the housing reserve fund is"},{"t":3558,"text":"a bonus. And my hope is actually that it helps"},{"t":3560,"text":"stimulate that park and get it going. You know, 2030"},{"t":3563,"text":"might sound like a long time from now, but it's"},{"t":3564,"text":"not. It's only four years. It is not a cookie cutter design."},{"t":3613,"text":"And it's got a lot of visual interest to it"},{"t":3615,"text":"without being cluttered. I really quite appreciate the design. The"},{"t":3619,"text":"fourth floor amenity space will be a unique draw to"},{"t":3622,"text":"the building. The"},{"t":3859,"text":"proposal is to rezone to a new site - specific"},{"t":3862,"text":"zone to increase the permitted density and to allow residential"},{"t":3864,"text":"use to enable the construction of a new six -"},{"t":3867,"text":"story predominantly residential building with 30 dwelling units and at"},{"t":3871,"text":"grade park aid and one story of light industrial space."},{"t":3875,"text":"Here are the relevant sections of the local government act."},{"t":3879,"text":"The rezoning application proposes increasing the density from 3. 0"},{"t":3883,"text":"to one FSR to 4. 77 to 1 FSR. And"},{"t":3888,"text":"adding residential use, while the development permit addresses the building's"},{"t":3891,"text":"form and character and includes variances for height, setbacks, parking,"},{"t":3896,"text":"and loading. Due to lack of alignment with city policies,"},{"t":3900,"text":"regulations and design guidelines, as well as the impacts of"},{"t":3903,"text":"the proposed variances. Staff recommend declining the application. Here's the"},{"t":3911,"text":"aerial photo of the subject property. The property is currently"},{"t":3914,"text":"vacant and is located on the east side of Russell"},{"t":3916,"text":"Street, south of the squamout road and the ENN rail"},{"t":3919,"text":"trail. The surrounding area includes a mix of light industrial"},{"t":3923,"text":"uses, low to mid - rise residential uses. The site"},{"t":3928,"text":"is located within the Esquimate Road Employment area and adjacent"},{"t":3931,"text":"to the new Lime Bay village. The area also hosts"},{"t":3935,"text":"a number of heritage registered and heritage designated properties. Here's"},{"t":3940,"text":"a photo of the subject property from Russell Street. We"},{"t":3943,"text":"can see the Victoria cannabis company on the left there"},{"t":3947,"text":"and the Ormonds Biscuit factory, which is currently a self"},{"t":3951,"text":"- storage facility on the right. Looking at the neighbouring"},{"t":3958,"text":"properties. There's a parking lot for the Victoria Cannabis Company"},{"t":3961,"text":"to the north in the image one. There are three"},{"t":3963,"text":"- story residential buildings across Russell Street to the west"},{"t":3966,"text":"in image two. And the Ormonds Biscuit factory to the"},{"t":3969,"text":"south in images three and four. Beginning with a discussion"},{"t":3975,"text":"on the rezoning application. Council should consider the land uses"},{"t":3979,"text":"proposed on the site as well as the density proposed."},{"t":3981,"text":"We can see the subject site on the left in"},{"t":3984,"text":"Vic West in the blue star. Within the context of"},{"t":3987,"text":"the official community plan, this property is located in the"},{"t":3991,"text":"residential fabric of the urban structure concept. On the periphery"},{"t":3994,"text":"of the lime bay village. This designation envisions a mix"},{"t":3998,"text":"of uses as well as a low rise fine -"},{"t":4001,"text":"grained rhythm, meaning typically smaller - scale buildings with active"},{"t":4005,"text":"uses to create and retain that village feel. The OCP"},{"t":4011,"text":"envisions a perimeter block form for residential development with buildings"},{"t":4014,"text":"framing the street while providing substantial landscaped open space in"},{"t":4019,"text":"the rear for trees and amenity space for residents. Disproposal"},{"t":4023,"text":"occupies nearly the entire site. And does not provide any"},{"t":4027,"text":"open space or landscaping. As a result, it is inconsistent"},{"t":4030,"text":"with the urban structure concept. The rezoning and development policy"},{"t":4038,"text":"provides more detailed site - specific guidance for land use"},{"t":4042,"text":"and built form. This identifies the site in the Esquimalte"},{"t":4045,"text":"Road Employment Area. The proposal aligns with the Envision uses"},{"t":4049,"text":"here. Including industrial employment and residential mixed use, again at"},{"t":4054,"text":"the blue star. Up to 2. 5 to one floor"},{"t":4059,"text":"space ratio and five stories in height. Is envisioned with"},{"t":4063,"text":"light industrial uses on the ground floor. Although the land"},{"t":4067,"text":"uses proposed are generally consistent with the OCP and the"},{"t":4071,"text":"rezoning and development policy, the proposals significantly exceeds the envisioned"},{"t":4075,"text":"density and height. Looking at the heritage context. Development should"},{"t":4083,"text":"reflect the local context and can both enhance and conserve"},{"t":4088,"text":"heritage while creating buildings of future heritage merit. New development"},{"t":4092,"text":"should provide a thoughtful design approach, adjacent to such buildings."},{"t":4098,"text":"The neighbouring Orman's Biscuit factory holds significant heritage merit based"},{"t":4102,"text":"on its architecture, location, and past uses. The proposal has"},{"t":4107,"text":"not provided an appropriate response to the heritage context. Looking"},{"t":4113,"text":"at some additional rezoning considerations. Typically, in order to achieve"},{"t":4116,"text":"additional density for residential rezonings, significant public benefit is provided."},{"t":4122,"text":"This may take the form of public - oal improvements"},{"t":4124,"text":"such as parks or plazas. Affordable housing commitments or secured"},{"t":4129,"text":"rental tenure commitments. Sufficient rationale for this increase in density"},{"t":4133,"text":"has now been provided. Additionally, a 0. 64 metre road"},{"t":4139,"text":"dedication is required at this site to achieve the mobility"},{"t":4143,"text":"and urban forestry goals for Russell Street. This road dedication"},{"t":4147,"text":"has not been provided. The proposal also includes three small"},{"t":4152,"text":"trees in planter boxes. Which does not satisfy the requirements"},{"t":4156,"text":"of the city's tree protection bylaw. The reasoning and development"},{"t":4162,"text":"policy also encourages meeting the family housing requirements of zoning"},{"t":4166,"text":"by LOU 2018. The proposal includes approximately 24 bedrooms that"},{"t":4171,"text":"would not be considered bedrooms under the zoning byla 2018."},{"t":4175,"text":"As they did not have operable windows. The reasoning application"},{"t":4179,"text":"is considered not supportable. Moving on to the development permit"},{"t":4188,"text":"with variances. Council should now be considering the form, character,"},{"t":4192,"text":"and design of the proposal and impacts of the proposed"},{"t":4195,"text":"variances. As I move through the plans, I'll mention the"},{"t":4199,"text":"supportability of the variances and note the main areas of"},{"t":4202,"text":"concern regarding alignment with the design guidelines. Here's the site"},{"t":4211,"text":"plan for the proposed Six Story Building, and here is"},{"t":4213,"text":"the footprint of the building. The proposed variances to the"},{"t":4217,"text":"rear yard setback in north side yard setback. Would enable"},{"t":4221,"text":"the building to occupy nearly the entire site. This is"},{"t":4224,"text":"inconsistent with both the perimeter block form and the design"},{"t":4226,"text":"guidelines. The setback variances are not supportable. On the ground"},{"t":4234,"text":"floor, we can see a portion of the industrial space"},{"t":4237,"text":"here. As well as the vehicle parking. Long - term"},{"t":4241,"text":"bicycle parking. And short - term bicycle parkind. The proposal"},{"t":4246,"text":"includes seven vehicle park installs where 36 are required, resulting"},{"t":4251,"text":"in a variance of 29 stalls. Staff did not consider"},{"t":4255,"text":"their proposed transportation demand management measures. Sufficient to support that"},{"t":4259,"text":"reduction. Here's the floor plan of the 2nd story, which"},{"t":4266,"text":"is entirely allocated to the light industrial use. And the"},{"t":4273,"text":"third story is the first residential floor with one studio"},{"t":4276,"text":"unit. One - one - bedroom unit. Two - bedroom"},{"t":4280,"text":"units. And two - three bedroom units. We can also"},{"t":4285,"text":"see here the three trees in plantar boxes on the"},{"t":4287,"text":"terraces of the two, three bedroom units. The proposal also lacks a well - designed interface"},{"t":4340,"text":"with the street. With the parkade entrance dominating the frontage,"},{"t":4345,"text":"in no transition zone, or landscaping. It also does not"},{"t":4348,"text":"respond appropriately to the neighbouring heritage context. This sow -"},{"t":4354,"text":"facing facade would be approximately four metres from the biscuit"},{"t":4357,"text":"factory, highlighting staff's concerns with heritage incompatibility for the north"},{"t":4361,"text":"- facing windows and signage of the factory building. Here's"},{"t":4367,"text":"the rear facade of the building. Similarly, composed of metal"},{"t":4370,"text":"cladding cementitious panels, glass, and concrete. And here's the north"},{"t":4377,"text":"side elevation, which would be facing towards the squad molt"},{"t":4380,"text":"road. Looking at the landscape plan, we can see the"},{"t":4387,"text":"small green roof sections, as well as the solar array"},{"t":4390,"text":"area, and the three trees planted in planter boxes on"},{"t":4394,"text":"level three there at the bottom. The proposal provides limited"},{"t":4398,"text":"landscaping, no shared amenity space for residents, and only three"},{"t":4402,"text":"trees in planters. These shortcomings reinforce staff's concerns regarding livability."},{"t":4408,"text":"Open space, and alignment with the city's design guidelines. On"},{"t":4413,"text":"balance, the proposal does not provide a sufficient response to"},{"t":4416,"text":"the city's general urban design guidelines. The development permit with"},{"t":4419,"text":"variances application. Is not supportable. Here's a recap of the"},{"t":4426,"text":"variances. Staff support the loading zone variants and the other"},{"t":4430,"text":"variances are not supportable. Ending on or rendering of the"},{"t":4437,"text":"building. Overall, this application proposes land uses that generally align"},{"t":4441,"text":"with the OCP. However, the proposed density is nearly double"},{"t":4445,"text":"the envisioned FSR, and a supportable rationale for this increased"},{"t":4448,"text":"density has not been provided. The proposal also deviates significantly"},{"t":4453,"text":"from the expected height and sighting and does not align"},{"t":4456,"text":"with the design guidelines on Foreman Massing. Relationship to the"},{"t":4461,"text":"street. Livability, shared amenity space for residents. Open space landscaping"},{"t":4467,"text":"in trees. And neighbouring heritage context. The proposal is also"},{"t":4472,"text":"inconsistent with the city's true protection bylaw and has not"},{"t":4475,"text":"provided the required road dedication. As a result. Staff recommend"},{"t":4481,"text":"council decline the rezoning application and the development permit with"},{"t":4484,"text":"variances application. However, through the update of the official"},{"t":5095,"text":"community plan introduction of the rezoning and development policy, there's"},{"t":5103,"text":"still an expectation that the property includes some residential use."},{"t":5106,"text":"However, the flexibility with addition of commercial, employment and residential"},{"t":5110,"text":"uses. Okay. That makes sense. Cause what, what I found"},{"t":5112,"text":"puzzling in the staff report is that it seems to"},{"t":5115,"text":"be treated to a certain extent as a somewhat normal"},{"t":5118,"text":"quote unquote normal residential proposal. And some of the comments"},{"t":5122,"text":"are more in line with what we would see and"},{"t":5124,"text":"just whatever residential part of Victoria. For instance, the perimeter"},{"t":5128,"text":"block concept. I don't understand why the perimeter block concept"},{"t":5132,"text":"would be applicable here in what is meant to be"},{"t":5134,"text":"an industrial zone. Can you comment on that? A majority of the floor"},{"t":5147,"text":"space ratio in the building is residential. Also the OCP"},{"t":5151,"text":"designation of the site is within the residential fabric. However,"},{"t":5156,"text":"within the rezoning and development policy, which zooms in a"},{"t":5159,"text":"bit further and it provides more specific guidance, it shows"},{"t":5163,"text":"that within that residential fabric, this is also kind of"},{"t":5166,"text":"a mixed zone that where we should have some industrial"},{"t":5169,"text":"use while also permitting residential uses. So because this is"},{"t":5173,"text":"predominantly a residential proposal and in the residential OCP designation,"},{"t":5180,"text":"the perimeter blog form is expected to be followed. Okay."},{"t":5183,"text":"That's a difficult one to square. And the same with"},{"t":5186,"text":"the tree protection bylaw. I mean, obviously if this were"},{"t":5188,"text":"again a normal residential zone and normal proposal, we would"},{"t":5192,"text":"have much greater concern for the onsite green space. So I'm just"},{"t":5201,"text":"a little bit, I'm having a hard time wrapping my"},{"t":5203,"text":"brain around the fact that we're trying to like get"},{"t":5206,"text":"trees and perimeter block into what is essentially an area"},{"t":5210,"text":"of warehouses. So I guess the question is how flexible"},{"t":5214,"text":"are we able to be? If we want to actually"},{"t":5216,"text":"add light industrial capacity in the city, which we have"},{"t":5218,"text":"not added a lot of because it often just doesn't"},{"t":5221,"text":"pencil for people. However, because this"},{"t":5258,"text":"has a majority residential uses is then treated more so"},{"t":5263,"text":"as a residential building requiring the alignment with the design"},{"t":5267,"text":"guidelines and alignment with policy to meet those residential objectives"},{"t":5272,"text":"that the city has. So it's in the follow -"},{"t":5274,"text":"up then is that if this project had a greater"},{"t":5277,"text":"ratio of industrial or commercial, would we treat it a"},{"t":5279,"text":"bit differently? The summary"},{"t":5996,"text":"provided by the Vic West Community Association Cleary Identifies issues."},{"t":6000,"text":"The proposed building would obscure the historic two - story"},{"t":6003,"text":"building to the South, the biscuit building. No landscaping on"},{"t":6008,"text":"residential Russell Street, shortfall on parking. Um, for residential and"},{"t":6013,"text":"commercial tenants from clients and potential use of the commercial"},{"t":6017,"text":"area to be cannabis processing. Comment has been made about"},{"t":6022,"text":"the heritage and industrial areas. As Victoria representative with Councillor"},{"t":6028,"text":"Lauten on the Canadian Capital Cities organisation, I've travelled to"},{"t":6032,"text":"a few Canadian cities in the last couple of years"},{"t":6036,"text":"with historical areas in them. And what is happening in"},{"t":6040,"text":"many cities with the terror industrial husband incredible. Transforming them"},{"t":6045,"text":"into community amenities through compatible industrial and commercial uses. This"},{"t":6050,"text":"proposal, in my mind, is so very wrong. Both as"},{"t":6054,"text":"a residential building and light industrial. It does not fit."},{"t":6058,"text":"And I don't think it has really considered the local"},{"t":6061,"text":"context. Quality of life matters for residents. This proposal doesn't"},{"t":6067,"text":"meet that expectation. And it's from a resident on Russell"},{"t":6079,"text":"Street and just says, enough of the discussing stink in"},{"t":6082,"text":"air pollution from cannabis producers. And he goes on to"},{"t":6085,"text":"talk about this being a residential street with a co"},{"t":6089,"text":"- op with kids that live there. And frankly, he"},{"t":6093,"text":"ends it with a very rough sentence, which is what"},{"t":6095,"text":"has Russell Street ever done to you people to make"},{"t":6099,"text":"us want to ruin our lives. And I think that"},{"t":6104,"text":"the cannabis cannot be overlooked. Now we learned only days"},{"t":6108,"text":"ago, at least I assume most people learned about it."},{"t":6112,"text":"Of a global survey of research and policy of the"},{"t":6114,"text":"legitimization of cannabis. The study titled International Cannabis Policies and"},{"t":6119,"text":"their association with cannabis use, cannabis use. Quint of art"},{"t":6123,"text":"mayor. This has absolutely nothing to do with the proposal"},{"t":6126,"text":"on the floor at cannabis's immaterial to the proposal. It"},{"t":6130,"text":"doesn't even come up in the staff report. And cannabis smell is also a real smell.
