We just like to acknowledge that the lands on which we gather and do our work is the traditional territories of the coast and straight salish peoples. Specifically we recognize the Luangan speaking people known today as the Songhes and Cassapsum nations that their historic connections to these lands and the adjoining waters continue to this day. I did have the um last week I was away in Whistler at the BC Association of Police Boards conference uh where we get together much like UBCM but for police boards. So there are a total of 15 police boards under the jurisdiction under the police services act that are municipal or or like uh governance. um that governance changes quite regularly and so once a year we get together both to make resolutions towards back to the province um but also just to do learning as it's uh there's always a constant turn of new uh police board members across the province. I of course sit on the BCAPB executive and so was involved uh in the organizing and uh but primarily just in the moderating and hosting of some of the events. Um very successful. I think the attendees found

it quite useful. Um, also want to just congratulate the Oak Bay half marathon organizers. It was a very successful event this weekend as I understand it and uh lots of smiling faces. I was there at the start line and there was uh lots of people I knew and lots of people I didn't know and everybody looking very healthy and uh excited to be out there. Um I want to just let people know if uh you're watching that the uh homebased business community openhouse is happening this Wednesday from 5:00 to 7:00 p.m. It's right here in these chambers. Um, and that's uh, I believe at the Windsor Pavilion this Saturday. Um, I also just wanted to touch on the fact there's been a lot of uh communication in the last few days about Oak Bay Marina and certainly I would encourage anyone interested in what's happening to go to the connect.bay.ca website. Uh, for those interested, council is of course looking to secure a qualified marina operator for the balance of the water lease. Uh, and we're hoping to have that done before the end of this year. Um, we also just the timing wise if people are

interested, we do anticipate having the proponent presentations uh here in this council on June 15th. this anticipated date. Uh we also of course last but not least have the tea partying coming up in two weeks. And since we don't have a meeting next week, I thought I would just remind people um I think there was some publicity of the uh the parade being cancelled, but the rest of the events are going ahead. So um it's a great community event. We love seeing all the people out. Um uh and there will be a mayor's teacup race, which we have a little bit of a a twist on it this year, which I'm quite excited about.

Municipality. Um everybody always seems to forget even though I lost your mind. My name is Dick Aenlech and I've been growing up here in Victoria and uh coming back uh a number of years later. Uh and uh I've got my wife Linda behind me. So, uh, in any event, um, we just want to, uh, express a few concerns about some proposals to develop. And, uh, on December 9th, 2025, we attended a public hearing on the proposed, uh, official community plan and subsequently attended an open house regarding the plan. Uh and to our surprise, we noted our home was now included also in a special study area which we had not heard of for us previously. Uh letter to the mayor and council was sent sent on December 18th, 2025 or relaying our concerns and subsequently a letter was received from Mr. Colin Brown uh senior planner and uh he was explaining we would still be zoned as residential. So there was some things that were not to be too worried about. Uh according to Mr. Brown, the

size and the unique characteristics important to the uh community and potential impact if redeveloped uh would be what the district will look for when the future development applications are received. And uh this was a bit of a flag to us to be honest. and uh an open invitation to developers uh did move forward with applications during that period of time. Um the recent uh proposed development uh would have serious implications for the surrounding neighborhood and uh the stretch of Beach Drive has always been a unique area uh for our heritage homes. a beautiful golf course, mature landscaping, open streetscape, uh predominantly low density residences and that and u then when we started finding just in the recent months uh that we were introducing an eight-story building and density associated with 54 units are right beside our house.

I'm just going to ask you not to speak to any specifications but just keep your comments in general terms. Apologize. No worries. Bit of an old guy here. uh that uh it represents a drastic and irreversible shift in the scale and the identity uh the uh identity of the area. And uh really what's our our question to our mind was like uh is this what's really best for the beautiful waterfront that we have uh in comparison to some of the developments that may occur. Uh the building would be significantly affect the character of the neighborhood. Uh affects traffic flow and volume, pedestrian cycling uh safety as residents come from the north end of the beach and and navigate for a left turn right into their new 54 unit home.

Again, just if we just don't reference any specific application and just speak to the to the potential development in that area, that's easier. Um anyhow, growth and change are inevitable, but the uh the growth uh we think should be uh guided by a clearly defined community support vision. We're not against the density within our community, however, and we don't feel this proposed development would fit though with our community, nor does it answer the need for affordable housing. So, we need clarity regarding what future vision of this area truly uh is before developments of this magnitude considered. and uh future growth should occur only after careful community input uh is obtained and should occur without eroding the unique character of the area. So uh we would really like uh this to have been uh taken forward if we can and uh you know if you could get some support for us in terms of uh having some differences between what's being proposed to be put on next door.

Sure. Well, there's a couple of there's two things and I'm happy to help out here a little bit. One, um, for any specific application, I always encourage people to speak directly with any applicants because it's often months or even years before it ever comes to council. It may change five or six times. It may never come here. So, uh, speaking to us at any time when it's early in the process is not, uh, we just don't have any input into the process. just so um every developer I've ever met is always has some way of contacting them and and does take input because at the end of the day they need to get approval and and at the end of the and so if they don't listen to the to the community early in the process they won't have answers or or ability to address it. So just that's always my general recommendation uh and secondly the special planning area in terms of uh having some differences between

There was a lot of speculation about what was coming and so we council wanted to recognize that there was uh those are very unique lots. they're very, you know, by the size and location, everything else. Um, but that we had not had a chance to even even have a conversation with the community yet about what would be appropriate there. And so, we just kind of flagged it and said, look, that is we

do we should do some proper planning for that, but it hasn't been resolved at all at this point. And we do have a few other high priority things and and so I can't give you a timeline for when that planning process would be completed. Yeah, we would encourage you to participate when we do do that work. I would look forward to it. I uh would hope that uh it would last more than a couple weeks to to get through it. But thank you. Uh we have first item is 6.1 which is loan loan authorization bylaws. um uh which is uh Miss Hunt who is our acting director of finance at the moment. Welcome, Miss Hunt.

Thank you very much. Uh good evening, mayor and council. Uh so the report before you is seeking uh security issuing resolutions um for a portion of the long-term borrowing amount that council has approved as part of loan authorization bylaws 4929 2025 and 4930 2025. As part of the borrowing process from the municipal finance authority, there are several steps that a local government must take. The first step is adoption of the loan authorization bylaw that's approved by the ministry and this sets the limit that the district is able to borrow under a specific loan authorization bylaw. It is valid for 5 years up to the amount included in the bylaw. The second step is council then approves the actual amount to borrow as part of a security issuing resolution.

So, after approving the loan authorization bylaw, we must wait the 30-day quashing period, which we've done, and then council may consider the security issuing resolutions. So, tonight you're being asked to approve funds to balance the 2025 and 2026 road reconstruction and storm sewer rehabilitation capital programs, and the amounts are based on the actual spending in 2025 and the updated 2026 capital plan. Additional security issuing resolutions under the loan authorization bylaws may be brought forward for the amounts in 2027, 2028, 2029 depending on the actual spending and the updated plans. The third step is for staff to then forward the resolutions to the CRD along with a certificate of approval from the ministry and that the district's borrowing is then included in the debt issue that is requested by the regional district to MFA on behalf of all municipalities that that submit. Uh the deadline to submit our application to the CRD is June 12th. So there is a one piece of information that is missing from the staff report and that's

concerning the debt servicing costs. So in the 2026 financial plan, uh staff had estimated the debt surfacing cost to be around $772,000 starting in 2027 uh for these issues. However, based on updated uh interest rates uh and amounts, the debt servicing is now estimated at 875,000, which takes the tax impact from 1.9% to 1.99%. So to summarize, the loan authorization bylaw is where council establishes an upper limit uh on the borrowing amount for planned expenses. And so those um bylaws included the 5-year capital plan from 2025 to 2029 for those two programs. And the security issuing resolutions is based on the actual expenditures uh and the amounts that we're actually going to borrow. So, should council approve the security issuing resolutions this evening, uh, these debt amounts will be forwarded to the CRD to be included in the 2026 MFA long-term debt issue.

Uh, I'm just going to add here, just I think if there's anybody watching that's not familiar with why we go through this multi-step process, and I appreciate councelor Patterson as our primary contact at the MFA uh, for all things. This is really just a a a joint and several liability approach that allows us to maintain a AAA borrowing rating um by having each municipality have a limited amount of borrowing, having this regional district sign off to understand that as a region we were within a a manageable debt level. Uh and then all of those are jointly uh raised up to the MFA who also has taxation authority and can draw uh from across the province to back uh borrowing. that that combination gives incredibly secure borrowing and and gives us access to the lowest possible rate. So if in case anybody's sort of wondering why on earth are we going to the CRD um that's a sort of quick and dirty uh uh background in terms of why that why this step is

necessary. Um I know people at this table know that but there are you know certainly people at home who may be sort of wondering why this this we go through these multiple steps. Um, with that, are there any questions to staff? Chelsea Braithweight. Uh, thanks so much and to you, Mayor. Um, thanks Miss you actually answered two of my questions which were around the debt servicing and the taxpayer impact. Um, my other questions would be um where does this boring place Oak Bay relative to? we're well below um the legislated uh debt servicing amount um and uh and the the amount required uh um from our electors.

And if I may, mayor, um the other question I would have is um are the project cost estimates still tracking as we had expected them to um or have the has influ materially changed those assumptions as was with the um interest rates? Miss Hunt? Yes. uh through the charity of council braithweight. So these two um uh capital programs are actually programs within the capital plan. Uh they're a little bit different than a capital project which has a defined scope. The program could we can change the scope on that. We can do more or less projects depending on the cost and so it does sort of fluctuate. the the capital uh plan sets an amount in the program based on sort of forecasted spending but those can fluctuate depending on yeah actual costs and cost escalation can certainly impact that.

So, I will just take the opportunity as we kind of move forward with this to make a few comments with respect to the uh to the borrowing. Uh I think a lot of members of the public who would be reviewing this borrowing and would be evaluating this borrowing would be asking some very legitimate questions with respect to significant amounts of borrowing and a 2% tax impact just to fix uh just to fix roads and to do the fundamental work that we need to do as a municipality. And uh this is I think as most members of the mun of the community are starting to understand is because of a huge amount of deferred maintenance that the district is now

playing catch-up on. Um but we need to recognize as a district I think it's important for members of the community to know that in the past especially for recent projects like Upland Sewer uh we have been fortunate to receive largecale federal and sometimes provincial grants to do this work. Those grants will no longer be available in the in the future and the approach that many municipalities have taken is to become increasingly dependent on those grants and to count almost count on those grants to complete these large scale catchup projects. Those are no longer be there. So I think the community needs to understand that if uh when they start seeing the impact of this borrowing on their tax bill that they need to understand that the other side of this coin is uh the course that a municipality takes with respect to revenue. And so I believe it is my opinion that the community uh if they have concerns about the level of borrowing and what we need to do in order to affect these changes is to look

no further than the course that has been taken with the official official community plan and uh the ability for this municipality to generate revenue and to generate tax dollars. So there is a disproportionate impact on current land owners in the district with respect to this borrowing. uh we do not have other sources of revenue and this is a a symptom in my view of the municipality's uh uh lagardness in in terms of developing additional sources of revenue to offset that tax impact. So I think it's very important for members of the community to understand why we need to borrow and why we need to borrow at such scales at this state at this uh point in time for the district you worship. And just in in listening to that, I will add that the amounts of borrowing that are proposed here uh in comparison to others around the region are very low. Oak Bay has had no debt and that was not necessarily a wise financial strategy to take over the years. And so now we um we have to undertake balancing uh the the the borrowing and the the the debt servicing against uh what our objectives are. But rather than um I I believe and I said this at the time we adopted the debt policy and the reserve funds. I believe that it is council's governance role to um to communicate to the district that we will not exceed a certain percentage of whatever the revenues are. So that could be a a sliding scale. Um I also am a firm believer in uh in reserve funds having having established targets of minimum and maximum thresholds so that the community at a glance can understand its

um uh financial health. And so uh I do think there is work for the elected officials still to do on this piece. And so I you know I hopefully that is what we will head towards in the future. I do believe that uh the debt uh plan that is in place to manage our our long-term costs. This is essentially you know mapping out our our total replacement over uh the next hundred years and sort of balancing that out. uh we do have to do it through a mix of debt and uh uh and the reserves that this council has been very diligent about putting away. Um I do think that there's uh I may have a slight disagreement with uh with councelor Appleton on the uh on the impact of this. I think we've always had a policy in Oak Bay of not using incremental tax

revenues to artificially lower tax uh taxes. we have what we have consistently been putting extra tax revenue recognizing that those extra taxes or extra uh people living here as additional burden as well. So that's cost to things like recreation centers and other services. So we haven't used that to sort of artificially keep costs down. So I I do think there is a there's been a policy decision here and certainly respect that could be changed in the future. Um but uh this council I think has been very disciplined over the years to to follow that policy uh to make sure that we are not uh sort of it's almost a secret tax for future taxpayers when you when you start uh using that money to fund current uh ex uh current costs. Again not subject to public input. This is the uh item 7.1 is adoption of a of a election signed bylaw. This has gone through three reading uh and back at this table for adoption. We will then come back to this table to give direction from the council table. Uh with this one, we have our 8.1 is 2026 2027 parks, wreck, and culture fees and charges. We have Mr. Julia, our director of parks, recreation and culture and district facilities uh here in front of us to uh to provide the uh the overview of these changes. Welcome. Thank you. Uh and I'd also like to acknowledge my colleague Camila Rock, our manager of administrative and reception services is joining me today to uh answer any questions following the overview. Um so the purpose of this report is to uh share the uh proposed amendments to the parks uh reculture fees and charges bylaw. uh as directed by council staff have drafted a fee schedule with a 6% increase uh to

recreation admissions uh uh and pass fees. Uh this increase was applied to the base rate and extended to all related admission fee categories and products uh in accordance with our established guidelines. Uh council will recall that this was direction that came out of the financial plan uh process and uh with a specific target for 2026. In addition to the proposed bylaw amendments um related to fees, there are also some changes that uh staff are recommending uh to better respond to service demands um and customer service and those are highlighted in the report. Um and then finally, I would uh note that the proposal is set to uh take effect September 1st, which aligns with our typical seasonal uh intake for the fall uh when we have been uh we've had practice of making those adjustments uh in the fall period. Thanks so much and thanks so much for both being here tonight and and for the report. Um I I wanted to ask about the continuous pass um because it's a it's an interesting operational change I think. Um, and I'm wondering if you can perhaps talk about what customer demand, customer demand or or market evidence supported moving from the three months pass to the continuous pass and an explanation for those who aren't aware of what a continuous pass is. Please, Mr. Slier. Sure. Through the mayor. So, uh perhaps I'll start with the uh sort of definition. And so essentially the continuous pass um allows for a user to uh enter into a program of uh of of almost a subscription state type of service where you have a a pass that is renewed on a monthly basis. um with additional flexibility to pause the account uh for a period of time if necessary. Um but allows that flexibility of of being able to just have the automatic charge go through rather than having to either repurchase a pass and go through the administration related to that um or put out uh the the full amount for say an annual uh uh pass all at once. So um it's an option that is increasingly popular in the recreation industry. Um I think just about everyone else in the region is offering this product. um and it's quite popular uh throughout um Canada as well.

Thank you because that was one of my other questions was um how many municipalities are already using that model successfully and and will we be tracking um I'm sure you will but perhaps you can just um expound on that um how you're going to track uh if this is causing a big difference to um like if we get a lot of cancellations let's say after you know somebody has their pass for a month or or will we be able to see um how it the changes between the continuous pass as opposed to the yearly pass or the three-month pass still here through the mayor. We are certainly always uh monitoring customer feedback that comes in um on any topic related to the services that we're providing. Um and with a change like this, uh most definitely we'll be monitoring the the customer feedback. Um based on our conversations with our counterparts and other uh jurisdictions, um we haven't really found a major downside. It's been quite uh wellreceived. Um, and as noted

in the report, it reduces the amount of administration for for staff and it allows customers the the ability to uh not have to worry about purchasing that next pass um as well as the flexibility to uh to pause the account. My last question would be um around um low in low-inccome access to our programs because this is a raise an increase in the pricing. So um and I know programs that are in place uh for people who might find that increases a barrier and perhaps you can just touch on that so that people are aware that we do have something in place for people who might find that as a barrier. The the light program or leisure involvement for everyone program is a is a program that OPA participates in along with all of the other uh recreation providers in the region. Um the information is on the district website about uh um eligibility thresholds and uh requirements, but essentially um patrons have the option of a two-year pass that provides them

Um I just wondered if you could elaborate um it's hard to understand from the chart what the scale of that might mean to certain organizations and I just wondered if if you could sort of give us a sense of like what the magnitude of of cost might be and whether you've had communication with organizations um around this um what seems to be a new thing but may not be. So if you could just clarify. Thank you.

This is actually um uh an attempt to um get everyone on a consistent and common foot um because we we have had a situation where some individuals have been paying for storage and other organizations have not been paying and so uh the rate that is being used is considered a nominal rate that is is not likely to have a major impact but um is certainly recognition of the value of space. Um so we do have for example the Canarvin facility that is currently uh there. Um there are a couple of storage units uh in that uh building as well as in the basement of Windsor Park Pavilion. Um and so yeah, this is this is an opportunity to essentially get um both the the the arrangement documented so that we have that um formalized um proper insurance and etc. and and access um and then also recognize the revenue associated with that. Um through Mayor, Director Sier, just one additional question around um noticing the the nonprofit rate discounted at 25% and just acknowledging that there's lots of local community groups that may not have formally um arranged themselves as a as a nonprofit. But I just wondered if you could speak a little bit to the type of um groups that sort of rent at the full rate um versus the nonprofit rate and just how it was arrived at the 25%. How how strict is the municipality on on the seeing the new definition in the report of being a registered nonprofit? Thank you, [snorts] Mr. Sier mayor. Um, so the change to the fees change from an occasional user and uh um and a regular user to a nonprofit user and a regular general user. Um, majority of our room rental users that were the regular users are our nonprofit organizations in the community. So that is the same sort of discount that they're used to. It's just a change in

Um, no. Just um appreciative of being able to um uh look at our our waterfront um and the context uh both environmental and um forming character um going forward. I know our waterfront is really important to our community and I just think it's important that we have a a conversation and and look at the different options that uh council has before us. Thank you very much. um and probably for a bit of context that people are wondering about this that came out of I think an application that came before council and there was some discussion around what was the setback from the shoreline from the from the property line to the buildings etc and so I think this is the intention here is to try and clarify some of those um for our clarification if publics if this motion passes we will get a report back which kind of lays out the the options for how this might be implemented timelines costs etc is that correct M Yes, thank you very much uh your worship. Um so council currently has a

council priority project to uh look at the prezoning and updating the zoning bylaw to modernize it. And so um what I would imagine is that this work would it be actually um form part of that work. Um otherwise it will sit as you know an outstanding council resolution and then we would look at okay where's the best best place to to fold this work into and I think that council priority project is uh is the best place to do that. Um and then obviously once we look at that depending on the scope of work uh we would report back but I think tying it in with that modernization of the zoning bylaw which uh council discussed uh on April 20th at the committee of the whole meeting and um you know made some other changes to to that uh scope of work. Um, I think that that's probably when we would report back that it doesn't get, you know, doesn't get lost in sort of the context of that larger project. Great. Thank you, Councelor Green.

Thank you very much. Maybe I'll answer your first question. And I think uh we want to look at this in the context of uh all of our shorelines and not just restrict to the special study area. That was my uh my understanding. Um and council did approve uh for the uh the zoning bylaw to continue on. Obviously the pre-zoning piece of that uh will be dependent on the uh infrastructure servicing study that has to come first, but the modernization and looking at uh other elements of the zoning bylaw that you know that will be starting now. So it'll be sometimes ne next year when council actually sees that zoning bylaw.
