This public hearing pertains to a city initiated application to partially exclude approximately 8.16"},{"t":1792,"text":"hectares of Collwood Creek Park from the agricultural land reserve."},{"t":1797,"text":"The notification period for this public hearing was from June 5th until today, June 22nd, 2026. During this time, the"},{"t":1805,"text":"public hearing binder was available digitally on the city's website and also available to review at the city's front counter. Notices were placed in the"},{"t":1814,"text":"Goldstream Gazette on June 10th and 17th, and a notice was also published on the city's website on June 5th."},{"t":1821,"text":"Postcards were sent to neighbors within a 100 meters of the park boundary on June 5th, and five notification signs were placed throughout the park on June"},{"t":1830,"text":"16th. To date, five written written responses have been received with three opposed and two in favor. I will now go"},{"t":1837,"text":"into the staff presentation detailing the ALR partial exclusion application for Cardiff Creek Park."},{"t":1846,"text":"So Collard Creek Park in its entirety consists of four legal parcels with three currently dedicated as park with"},{"t":1854,"text":"one held in fe simple. The park is approximately 11.84 84 hectares with existing recreational infrastructure on"},{"t":1862,"text":"site, including a playground and a splash pad. This application in no way loses the protection of dedicated"},{"t":1868,"text":"parkland. This application requests the removal of the provincial ALR designation. Park dedication is a strong"},{"t":1876,"text":"legal status and disposing of any dedicated park would require electoral approval, not just a decision point of council as required and outlined in the community charter."},{"t":1886,"text":"Coward Creek Park is identified as a park space in all relevant city plans, including the OCP, the land use bylaw,"},{"t":1893,"text":"the parks and recreation master plan, and the Cwood Creek management plan."},{"t":1899,"text":"Recognizing that there was one parcel that is not formally legally dedicated as park, staff are recommending that council initiate the process to formally"},{"t":1907,"text":"dedicate that last remaining fee simple lot to provide further protection and clean up the legal requirements from that original 1985 subdivision."},{"t":1919,"text":"All properties are zoned AG1 which has [clears throat] limited permitted uses primarily low density residential including including single family and"},{"t":1927,"text":"agricultural uses. The land is designated as municipal parks and open space in the OCP which limits the use of the land to align with that designation."},{"t":1937,"text":"Any uses of the land outside of park or agricultural uses would require an OCP amendment and a resoning led by the"},{"t":1945,"text":"city. There is currently no intention to change the OCP designation designation or resone the lands. So just to ensure"},{"t":1953,"text":"clarity, this application is only requesting to remove the provincial ALR designation."},{"t":1959,"text":"[gasps]"},{"t":1960,"text":"The parks and recreation master plan classifies Cwick Creek Park as a community park, which are large destination spaces that benefit the"},{"t":1968,"text":"broader community and are most often centrally located and widely accessible to all residents. The Calbert Creek Park management plan involved significant"},{"t":1977,"text":"engagement with the public to determine the community's priorities for the park."},{"t":1981,"text":"The plan was adopted with a number of capital recommendations based on what we heard from the public, including a new washroom facility."},{"t":1990,"text":"All planned improvements are currently located in the ALR, which significantly limits the city's ability to implement the park management plan. With the"},{"t":1998,"text":"current ALR designation, the plan cannot currently be implemented as envisioned and endorsed by council and the public."},{"t":2008,"text":"The Agricultural Land Commission or ALC is an independent provincial agency whose core objectives and mandate is to"},{"t":2015,"text":"preserve agricultural land. Collarded Creek Park is currently classified as open land where passive recreation is permitted with limitations."},{"t":2024,"text":"All existing facilities, including the Splash Park, playground, dog park, and trail network are all currently located in ALR land, and the ability to"},{"t":2032,"text":"construct new or maintain infrastructure is severely limited."},{"t":2039,"text":"[gasps]"},{"t":2039,"text":"There are additional application requirements for the ALC to consider the request. That includes a council resolution to authorize the application"},{"t":2047,"text":"which is planned for later this evening, a land capability assessment, an online online application portal including"},{"t":2055,"text":"maps, site plans, current agricultural uses, notice of public notification, and a report of public hearing."},{"t":2064,"text":"There is a small application fee and the application is then forwarded to the ALC for decision. The current ALC guide book"},{"t":2071,"text":"knows an estimated 90 business day decision turnaround."},{"t":2077,"text":"The current partial exclusion application requests to remove approximately 8.16 hectares of the 9.92"},{"t":2085,"text":"hectares currently in the ALR. The remaining 1.76 hectares is to be retained in the ALR."},{"t":2093,"text":"As mentioned earlier, the ALC's mandate is to preserve agricultural land. So, a partial exclusion application is more"},{"t":2101,"text":"likely to align with this mandate as it retains a portion of the land within the ALR."},{"t":2108,"text":"This approach also ensures that areas the city does not intend to develop for park use remain protected for agricultural uses."},{"t":2117,"text":"To give a brief history of the application, staff initially brought forward an ALR exclusion application in May 2025 as the planned improvements were impacted by the ALR designation."},{"t":2129,"text":"Council resolved at that time the application be referred back to staff for additional information. And in December of 2025, staff brought forward"},{"t":2137,"text":"additional information and recommended a partial exclusion application."},{"t":2142,"text":"Council resolved to make an ALR partial exclusion application and explore community agricultural and educational"},{"t":2149,"text":"uses for the non-excluded part of the park."},{"t":2153,"text":"Staff then came forward in April of 2026 requesting formal dedic formal direction to schedule public hearing which was passed and that is uh tonight's public hearing."},{"t":2166,"text":"A land capability for agriculture assessment was conducted which concluded low to very low limited agricultural"},{"t":2173,"text":"potential across the park citing stoniness, poor drainage and periodic flooding with the final recommendation being that the park is not suitable or viable for agricultural production."},{"t":2186,"text":"As for the local government acts and applicable city bylaws, five development signs were installed at Cardwood Creek Park at all vehicle and pedestrian"},{"t":2194,"text":"entrances and postcards were sent to properties within 100 meters of the entire park and a public binder was posted on the website and available in"},{"t":2202,"text":"person and two notifications uh were posted in the newspaper."},{"t":2208,"text":"The staff recommendation for consideration tonight is that the partial exclusion application for Cardwood Creek Park from the ALR be"},{"t":2216,"text":"forwarded to the ALC for consideration and that council direct to prepare direct staff to prepare a legal survey"},{"t":2223,"text":"for the portion of Cwood Creek Park that is currently held in fe simple and to proceed with the formal dedication of that parcel as parkland."},{"t":2232,"text":"Thank you very much."},{"t":2234,"text":"Thank you very much. And at this point in time, I'm going to uh for the first time, I'm going to uh invite the public"},{"t":2241,"text":"to provide uh their input on the proposed application uh for partial exclusion of the Carwood Creek Park from the Yal."},{"t":2250,"text":"So, can I have my first speaker, please?"},{"t":2265,"text":"Yeah, you got to push the little Can I speak now? I'm at 31. My name's Ra"},{"t":2275,"text":"Larson. I'm a 3106 answer bus. I just bought it two years ago. It was sinking when I bought it and we're suing the people who sold sold it to us. We bought"},{"t":2282,"text":"it in particular because I have a service dog and I was in the Canadian Forces and that's why we bought the house. Um"},{"t":2290,"text":"my main concern with what you're doing is that um I'm noticing that callwood people don't really use it very much."},{"t":2296,"text":"It's actually Langford people because we're right on the galloping goose and people are coming over for [snorts] it."},{"t":2302,"text":"So my issue is that with the with the um bathrooms um there's lots of places to go bathrooms. I mean, it's literally"},{"t":2311,"text":"less than 3 minute walk to town and I feel like uh homeless people are going to be brought in if bathrooms are brought in and then it's going to end up being in a camp because there is no"},{"t":2320,"text":"other place in West Shore for that to happen. We're right in the middle. So, that'd be um my main concern there. And then for safety, where you guys are"},{"t":2327,"text":"putting the picnics tables, um you guys are putting in a dark area, you're also putting it in a the one that's like um"},{"t":2335,"text":"on Britney, there's like three picnic tables. You guys are putting it in a dark area and you're also putting it in a wet area. And also when you look from"},{"t":2345,"text":"anybody in that little area's houses onto into that what's proposed to be the"},{"t":2351,"text":"um the on leash, which I believe there needs to be one. There should be an on leash and an off leash. So I do agree with that. Um and where you guys have it"},{"t":2360,"text":"for on leash is perfect. um is that um when people are looking from their houses, it's us that are going to be taking care of us. So unless you guys"},{"t":2368,"text":"are going to have 247 um security in there, which I highly doubt, so far it's been me and a couple other people who have called the police"},{"t":2376,"text":"with regards to stuff going on in that little area at nighttime. Um um we can't really see it. So there'll only there'll only be two people that"},{"t":2385,"text":"can really see those picnic tables. Keep your eye on them. If they were to put be put more in the middle in the non ALR area, then every single person around"},{"t":2393,"text":"that little that little off leash area would actually be able to see that. And then the I guess the the third thing is"},{"t":2400,"text":"is the fence. So there's a proposed fence that's supposed to go around there. I'm wondering, are you guys planning on cutting down everybody's"},{"t":2408,"text":"um everybody's hedges? Because when I look around, I walk around there every day, two, three times a day with my service dog. um everybody's hedges are"},{"t":2417,"text":"growing through the existing um uh pick a fence that's there. So you guys would have to cut off like almost almost"},{"t":2426,"text":"everybody's hedges. So that's that's the only three things that that really concern me. Like I think everything that you guys are kind of doing is is fine,"},{"t":2434,"text":"but bringing in those um bringing [snorts] those those um bathrooms I think is is is going to cause more problems."},{"t":2445,"text":"And uh what I'm wondering is what are you guys going to do with security? The bottom line is if you were to Google ALR right now, the first thing it would say is it came into"},{"t":2509,"text":"effect in 1974 in BC. It was met with broad applause and it was intended to preserve in perpetuity lands whose"},{"t":2519,"text":"potential greatest and best use is for production of agricultural crops. Right?"},{"t":2525,"text":"That park does not contain land suitable for agricultural crops. None of it should be in the LR. If you look at it, take a principled approach."},{"t":2536,"text":"You even had a man drone consulting did a report in 2025. They they brought on board two professional aologists to confirm their [clears throat] findings."},{"t":2545,"text":"Their findings were the vast majority of Cowwood Creek Park is not suitable for agricultural purposes. It's got poor"},{"t":2552,"text":"moisture retention. It's got poor nutrient retention. It's rocky. It's uh"},{"t":2557,"text":"[clears throat]"},{"t":2558,"text":"it's non-airable. Those are the factors that make or break agricultural land."},{"t":2564,"text":"None of that part falls into that category. So, I mean, it's your decision if you want to remove the the majority of the park, the 11 hectares, and leave"},{"t":2573,"text":"the two or three hectares in the ALR. I just want to go on record saying if you take a principled approach, that"},{"t":2580,"text":"approach doesn't make sense because it none of it's suitable for ALR."},{"t":2585,"text":"And I was more hung up about it before, but now I have a better understanding of what the parkland documents say about how we manage that park, what the your"},{"t":2594,"text":"bylaws say. uh your worship and I'm satisfied that the park infrastructure the l r rules legislation"},{"t":2604,"text":"um the covenants in those documents do an adequate job. Um I just wanted to ask a a question because I've"},{"t":2632,"text":"never really understood the whole the whole um application is to remove a significant portion of the park"},{"t":2640,"text":"from the from the ELR and that was really only to accommodate initially a a parking area which I think has already"},{"t":2648,"text":"been uh built uh but can't be used and and and washrooms. Well,"},{"t":2654,"text":"those two parts are really a sliver of the existing park. I don't know why one would have to remove the vast majority"},{"t":2663,"text":"of the park from the ALR just to accommodate uh a couple of uh uh slivers. My major concern in in all of"},{"t":2672,"text":"this is the long-term uh development potential uh for the park. Um, my first"},{"t":2681,"text":"introduction to Collie Creek was when the city wanted to uh turn a significant portion of the"},{"t":2688,"text":"park into a a wetland uh drainage area uh filtration area to solve a triangle mountain drainage uh or storm water"},{"t":2697,"text":"drainage problems. Since that time uh there have been uh ideas floated I'm not sure whether floating or otherwise"},{"t":2706,"text":"turning into a a sports facility you know with various uh playing fields ball fields what have you of late uh the um"},{"t":2715,"text":"uh the callwood um sorry raised garden beds uh in a portion"},{"t":2724,"text":"of the uh of the And what this leads me to is that"},{"t":2732,"text":"regardless of what the current council thinks or two or three or four councils uh after after you uh all of the"},{"t":2741,"text":"projections that are in place are simply based on um uh official planning documents that exist right now. I know"},{"t":2748,"text":"that in in looking at the Royal Bay development uh that has certainly evolved a number of times from the time"},{"t":2755,"text":"it was first proposed uh to now. You're already dealing with the Tamarak uh uh"},{"t":2761,"text":"development. Um that was never uh contemplated uh way back when those"},{"t":2768,"text":"neighborhoods were um uh were first proposed and then developed. So there's nothing"},{"t":2776,"text":"preventing future councils from dramatically changing uh uh the park use. My major uh concern is that that"},{"t":2784,"text":"whole piece of land is ideal uh uh for development, condo development, apartment"},{"t":2791,"text":"development. We are surrounded by fairly significant amounts of large scale development. It would be very very easy"},{"t":2798,"text":"for future councils to arrange u for this uh regional jewel uh to be"},{"t":2808,"text":"transformed into something which bears no resemblance to what it currently is."},{"t":2814,"text":"It was uh I started off with a with a question. I have no idea why there's a requirement to actually remove the bulk"},{"t":2822,"text":"of the park uh from the ALR now just to accommodate a couple of uh uh very very"},{"t":2829,"text":"small minor uh uh requirements but my major long-term uh"},{"t":2836,"text":"uh concern is the issue of development and that's all depending on the nature of the various councils and the various proponents which are going to appear in"},{"t":2846,"text":"the in in the coming years. Uh even now I have small raised garden beds and it's cheaper for me to run out to uh a"},{"t":2935,"text":"market garden out in the peninsula to buy something as it is to try and grow it."},{"t":2941,"text":"Why can we not just very simply keep a green space? Um, contrary to a friend who"},{"t":2961,"text":"is against bathrooms, I agree. We've got a problem. I'm one of the people that's had to go and ring a doorbell and say, \"I live at the end of"},{"t":2984,"text":"a Flanagan place, but I'm never going to make it home. It's I was going to approach council on its own and have been threatening for years."},{"t":3080,"text":"We do need to do something about the speed limit down Sunridge Valley. And I think everybody can agree. People"},{"t":3089,"text":"rip into the dog park. They park. They walk their dogs. They come out. And no kidding you. I mean, I try to cross from"},{"t":3097,"text":"Flanigan Place to go to the other side of the street on the other side of Sunrise. I can look right, I can left, I can look right again, and there's a car"},{"t":3104,"text":"on top of me. They get out of that dog park and it's 0 to 60 in 10 seconds flat. We have a default speed limit of"},{"t":3112,"text":"50 kilometers. Uh the reason why we"},{"t":4335,"text":"have door-to-door postal delivery right now is because the massive mail kiosk that was uh just across the road on"},{"t":4343,"text":"Sunridge Valley Drive from uh what has now become the children's play park. Uh it was blown up twice with Halloween"},{"t":4352,"text":"pipe bombs. Uh you know, so the issue of vandalism uh in fact is uh is is real."},{"t":4360,"text":"So it's an issue which needs to be dealt with. Oh, I didn't mention we've lived here since uh 1993. So, the other the"},{"t":4369,"text":"other issue uh is regarding uh dogs. Uh uh we're dog owners. Uh we used to have"},{"t":4378,"text":"a a collie a number of years ago. Uh we used the park every every day. And this was obviously a number of years ago"},{"t":4386,"text":"before uh the mass of dogs that you now see uh uh became as popular as they are."},{"t":4393,"text":"In our case, now with our dog, uh we've gone into the habit where we do not go into the park uh unless he remains uh"},{"t":4401,"text":"off leash. Uh the the main part of the uh park has become less friendly uh over"},{"t":4409,"text":"the years. Uh not really certain why that is. Uh unfortunately our uh uh"},{"t":4416,"text":"regional park of choice for our dog has become the view world uh park and they"},{"t":4422,"text":"have a a massive um off leash uh area within their park. They also have uh uh"},{"t":4430,"text":"an area where they have um uh garden beds and they have another portion uh with a play park and and also a uh like"},{"t":4439,"text":"a BMX uh bike track area and uh uh that arrangement works very very well. For"},{"t":4447,"text":"whatever reason, the the character of the dogs and the people who who who who frequent uh that park in particular, the"},{"t":4455,"text":"the off leash uh portion are are friendlier. Um anyways, the uh uh the"},{"t":4463,"text":"park is more is more inviting. Not really certain uh why, but it just is from our our experience. I would comment"},{"t":4471,"text":"that in terms of washrooms, they they have one particular uh porta potty uh"},{"t":4477,"text":"which is set up u between the uh two areas near uh uh the play park and uh"},{"t":4486,"text":"water fountain. It's uh surrounded by a wood lattice uh frame."},{"t":4493,"text":"Um it seemed to fit in uh to their uh to their park. It's it's well used. Um but now having a wholesome"},{"t":6265,"text":"understanding of the limitations of the park, um I do think that the partial exclusion strikes a good balance, um and"},{"t":6273,"text":"allows the city to carry on with park plans and amenity improvements. And I think uh maybe just a question for"},{"t":6281,"text":"staff, the Cecil blog side of the park, is it it currently compliant with the uh agricultural land reserve with its current use?"},{"t":6295,"text":"Thank you for the question. Um, and I think they just want to feel, you know, to ensure that future councils cannot"},{"t":6338,"text":"just come in and reszone and build, you know, um, condos and and town homes and"},{"t":6345,"text":"stuff. Um, right in the same ballpark, uh, literally. I just would like staff to explain"},{"t":6365,"text":"if there were and there is not but if there were an attempt being envisioned"},{"t":6372,"text":"to build something where it is currently zoned for a park any of our parks could you explain what the protections are"},{"t":6380,"text":"that currently exist for our dedicated parks in Colwood. Yes thank you for that question as well."},{"t":6388,"text":"So when a park is dedicated like legally dedicated as park that is very significant and strong protection there"},{"t":6396,"text":"is very clear guidelines in the community charter that talk about disp disposition of land that goes through a"},{"t":6403,"text":"very significant public process. Um and then the resoning would also have its own public process as part of the local"},{"t":6409,"text":"government act um and an OCP amendment because that is the land use designation. there there are very"},{"t":6417,"text":"significant um hurdles or um legislation in place that would have to take place to even"},{"t":6425,"text":"consider reszoning or an OCP amendment or disposition of current um parkland."},{"t":6432,"text":"And I think it would still require a um referendum as well uh to remove uh to to"},{"t":6441,"text":"reszone Parkland to another designation or whatever it might be."},{"t":6446,"text":"Yes, there's um an electoral vote for the disposition of parkland that would be required."},{"t":6451,"text":"So it couldn't happen. You wouldn't miss a meeting and accidentally not know about it or be unaware that it was being"},{"t":6458,"text":"proposed. Those things would would require notification and an actual referendum where the whole"},{"t":6465,"text":"community would have to vote for those changes to take place."},{"t":6472,"text":"Um Mr. Johnson and I'll I'll send it over to council ward after that, please."},{"t":6476,"text":"Yeah, if I could just um refresh council's memory, if you'll recall when this originally came up, um it was a surprise to city staff. It was"},{"t":6484,"text":"designated in the ALR. In fact, it was uh quite the headline in the Goldstream Gazette about the city missed that. And this falls into the lessons learned and"},{"t":6492,"text":"council put a hold on any new park improvements in this area with the understanding that if those improvements went in and they weren't meeting with"},{"t":6499,"text":"the ALR, they would technically have to be taken out if the ALR said no, this isn't a permitted use. So that's why we"},{"t":6507,"text":"proposed an entire exclusion which council pushed back and said no we think a partial exclusion in this place would make more sense and legitimize those"},{"t":6516,"text":"park improvements. U the public has said you know the parking area was kind of put in and then stopped. It stopped because we were aware that it was in the"},{"t":6524,"text":"LR and that's what started the genesis of this application."},{"t":6528,"text":"um having a long tenure in local government uh worked in certain municipalities that have tried to uh"},{"t":6535,"text":"reduce parkland and uh similar to what we see here tonight. It does get a great response from the public and there are protections in place for that park uh"},{"t":6544,"text":"continuing as its use without that ALR designation that staff have mentioned. Um I I think first of all it's important to acknowledge that you know there there's a lot of"},{"t":6561,"text":"in-depth information to cover on this particular topic but it's an emotional topic and I think we have to address"},{"t":6567,"text":"that that um how this sort of became in in the public sphere more recently was around this garden proposal which has"},{"t":6575,"text":"subsequently been withdrawn and I think that blindsided a lot of residents. I think that's fair to say. I think you know there's lessons learned as Mr."},{"t":6584,"text":"Johnson just stated um in how that was handled. I don't think anyone did anything maliciously. I think you had a a group that had a a funding opportunity"},{"t":6592,"text":"and and tried to pursue something. We had an ALR designated piece of land."},{"t":6595,"text":"They were excited about it. But the folks that live there, the folks that are here and others who are not, um I think we're a bit blindsided. And when"},{"t":6603,"text":"you're blindsided by something, you know, one of the emotions you start to feel is is fear and trepidation about, you know, what's going to happen? Um"},{"t":6611,"text":"what's the agenda here? What else could happen? And that's where I think you start to hear comments about things like development. Um, you know, there was a"},{"t":6618,"text":"development proposal that came before council recently and and I've seen and heard, you know, mentioned to that with this, well, they allow a condo building"},{"t":6627,"text":"to get built there even though it's in the OCP. Um, but, you know, this could happen here. And and I think it's unfortunate because I think at the end"},{"t":6634,"text":"of the day, we're we're very much coming from the same place. And I say we, I say city staff, I say council, and I say many of the people in this room is that"},{"t":6642,"text":"we all view Cwood Creek Park as as a jewel. It's it's a beautiful green space um in Cwood that um offers, you know,"},{"t":6652,"text":"not only opportunity for children in the playground and for for dogs to get some exercise, but it's got extraordinary"},{"t":6658,"text":"wetlands. Cwood Creek is is great. Um little Grayson's Pond that's there that can be home to ducks and things can be great. And I say can be because off"},{"t":6667,"text":"leash dogs are everywhere in that park right now and they run through everything. Um I I've tried to connect with some of the residents in the area."},{"t":6676,"text":"Not not all were willing to to meet as we know. But uh I met with some folks there this Saturday who you know reached out and said, \"Yeah, let's let's walk"},{"t":6684,"text":"you through folks that lived on Sunidge and said, \"Let's let's walk through the park.\" And while I was doing that, I watched off leash dogs tear through the"},{"t":6691,"text":"pond, tear through the creek, um run into the playground area, which is sort of an open fence enclosure. Um and so"},{"t":6699,"text":"there there are real issues with with some of those things. And I hear people in this crowd tonight saying, you know, we'd like to have some amenities. We'd"},{"t":6707,"text":"like to have some benches. um you know, we'd like to potentially see fencing in areas to, you know, to preserve the"},{"t":6714,"text":"ecological value of the creek and and things like that. So, I would say all of those things were aligned. Um the one gentleman who who mentioned moving there"},{"t":6723,"text":"because of his service dog, he said, \"Well, this is my Stanley Park.\" And I understand the reference because Stanley Park is a jewel obviously in Vancouver, right?"},{"t":6730,"text":"We think of the nature element, but Stanley Park also has washrooms, a sports field, an aquarium, an outdoor swimming pool, tennis courts,"},{"t":6739,"text":"restaurants, concessions. We are not talking about that here. I think the closest thing we're talking about that is is is washrooms. And that's a valid"},{"t":6747,"text":"concern, I think, to to talk about the proximity to, you know, what's going on in Langford. Uh the RCMP showed us the"},{"t":6754,"text":"heat map of where crime occurs in the west shore and no coincidence that it's it's a lot redder along the sort of"},{"t":6762,"text":"borders with Langford and the urban area there. And that's not a slight against Langford for anyone who thinks I'm politicizing that. That's just the reality of a of an urban environment as"},{"t":6771,"text":"it grows and the problems that come with that. So your concerns are very valid about it spilling over into the park. So I think we have to consider okay what"},{"t":6778,"text":"what could we do if we built washrooms to keep them secure? But the message I think I'm trying to convey here to the community is that, you know, we want to"},{"t":6787,"text":"preserve the green space. We want to do the very things you're talking about."},{"t":6791,"text":"Protect the creek, protect the pond. Um the the neighbors that I spoke to on Saturday said to me, Ian, we we want the"},{"t":6799,"text":"dogs fenced in in in somewhat of the area that's proposed. They actually suggested move it further down along Cecil Blog towards Veterans Memorial up"},{"t":6807,"text":"near the Burm. You know, leave more of the open green space. don't put it out in the center, but they said, \"We want a fence dog enclosure so that the dogs can"},{"t":6815,"text":"go and still run and people will view it as a destination coming from the Cecil blog side, but then they won't be allowed to, you know, to run free and"},{"t":6824,"text":"run through the creeks and in the other areas around the playground seem pretty logical. Um, no wholesale changes, just some of the things that we're talking"},{"t":6831,"text":"about. So the only conundrum I find or the the wall I'm running up against is that we can't do those things that you want without removing it from the ALR."},{"t":6840,"text":"So the the last piece I'll mention here before I I give way to others is that these these folks I met with on Saturday said the same thing. They said our"},{"t":6848,"text":"concern is you take it out of the ALR, how are we protected? And I think that's a very valid concern and it's on us to reassure the the the folks that live"},{"t":6856,"text":"there. And I think there's more we can do beyond just the parkland protection."},{"t":6859,"text":"You've heard that the parkland protection means it it cannot be a council vote. Council cannot decide arbitrarily that we want to proceed with reszoning and pursue development. It"},{"t":6868,"text":"would go to the electorate. It would have to go out in the form of a referendum or alternate approval process. So it would be something that"},{"t":6876,"text":"comes to the community. But beyond that, we could look at things like restrictive covenants registered on on the title of the land. We can look at conservation or"},{"t":6884,"text":"ecological covenants. Um these things on their own don't necessarily lock anything down but form as part of a"},{"t":6891,"text":"package. They create a very very difficult way to to change anything on that land. Um incorporating it into a"},{"t":6899,"text":"formal park management plan which we have integrating it by bylaw that becomes part of that. When we look at amending the official community plan you"},{"t":6907,"text":"anchor the policy into the OCP. So when you've got these three or four different mechanisms plus the existing park"},{"t":6914,"text":"management under the the local government act, it's not going anywhere."},{"t":6919,"text":"And that's how almost every park in the region is governed. So I feel very confident that we can take portions out of the ALR um to do some of the things"},{"t":6928,"text":"you want to do. And then the work falls to us, I think, to reassure you that this isn't about building buildings there. Maybe there's a picnic shelter at"},{"t":6936,"text":"most. Maybe there's a washroom. We can have more discussion, but I think you've got to add the the appropriate fencing and things to to do exactly what you"},{"t":6944,"text":"want, which is preserve this park for for the future. Allow the ducks to come back and and not be chased by the retrievers through the pond, right?"},{"t":6952,"text":"Allow the creek to flourish. Um, these are some of the things that I think we have the tools to do. I believe that we're very much aligned on that. The change in the geography of the park and my opinion the natural beauty that was exposed many people"},{"t":7014,"text":"didn't even know there was a creek there because you couldn't get near it or see it. Um I think there was uh there is"},{"t":7023,"text":"certainly something to be said about fencing to protect natural elements and if that's required that's something the"},{"t":7032,"text":"AL needs we need to pull from the ALR to do that. There's been a lot of indigenous plants uh have been planted there. Neighborhoods in that community"},{"t":7041,"text":"have contributed trees. Some people dropped by with some. help put them in the ground. And I see the long-term"},{"t":7048,"text":"potential in that park is is pretty great. And I think that the uh trying to get a handle on the dog situation during campaigning with the"},{"t":7057,"text":"wall three and a half years ago, I know that there were some people talking to me about and as we spoke on the side of the on the sidewalk there at the parking"},{"t":7065,"text":"lot and uh uh end uh and and dogs were tearing each other around and uh running around and fights were breaking out and"},{"t":7073,"text":"so on. So I think that the CRD dog control situation needs to be dealt with. Fencing protection, natural restorations. There's so many elements"},{"t":7080,"text":"that could be worked on. I agree. The washroom situation is one to consider because the concern about vandalism has spoken to is always a a concern and I'm"},{"t":7090,"text":"sure staff maybe Gord you want to speak to that a little bit about the uh uh strategies that are in place in other parks.
